i have been paying them monthly since march for an old cc debt. i missed my may and june payments so on last friday, i called to make a west union payment. of course i was told i had to pay 100.00 (for may and june). all i had to send was 50.00 so i sent that and was told 100.00 (for june & july) would be due july 14. when i called back with the mtcn that day, ms davis told me that july 14 wouldnt work and i had to pay 100.00 july 6. well i said ok- yes, knowing that i would only have 50.00 xtra to pay today- so anyway, i sent her 50.00 today for my june pymt (since julys shouldnt be due til the 30th) and i called her with mtcn. she totally went off saying that that was not fine and that i agreed to 100.00 today. i really didnt agree, she is the one who changed the date. anyway of course they are taking the 50.00 i sent today, but i explained to her i cant pay the other 50.00 til tues, july 10 (which is just 2 business days away). anyway, it is julys payment so i am caught up per our agreement. she said i have until 2:45pm today to send her the other 50.00. i dont have it, i dont have family/friends that i can get it from. can she do this and what if i just send her 50.00 tuesday per what i said? what can they do?

please help

So are they collecting on a charged off credit card account?

If you don't pay today there is nothing they can do. Just pay on Tuesday, tell them that and if they don't like it, too bad. They can't have you arrested, they can't get a judgment against you by Tuesday so there is nothing to worry about. Just pay on Tuesday you will be fine.

These attorneys are representing the finance company that my car is financed through. They showed up at my meeting of creditors for my Ch 13 BK. From my understanding, they have offices throughout OH.

Get an attorney ,they do not play fair and get judgements against people without their knowlege.
They will not validate,but will scare you into making
a settlement or payment arrangements.Often debts are passed SOL...........

it's time that we fight back against these people.
Anyone that has dealing with this company or LVNV Funding and have not been able to get validation...Please file a complaint with FTC.FTC will investigate and pass this info to all needed shared agencies.

I am looking for advice on how to deal with these bottom feeders. I have had similar experiences with them like the rest of you. Can they be beat and how?

Don't know if they can be beat or not, but I am dealing with them too. The best offense with them, is to become educated as to your rights, and let them know you know them. Once I started sending debt validation letters, and communicating what they have done wrong, they got a little nicer!

I wasn't able to make a payment on time to them once, and they started with, you better send it within 5 hours, blah, blah. I stated, hold on, I'm trying to get this all written down and you are talking too fast, they cahnged their tune!! I sent my payment by money order, no checks, when I was able, and they didn't refuse it!

Please be aware that LVNV does sue, and these people are associated with them. But as I said, be aware of your rights, document everything, take notes,etc.

Thanks for the encouraging words Bossy. How do I get in contact with Karen? I am pretty worried about these people. I have been documenting everything and I sent out the validation letters. What are all of the Rights one has and how does one find out what his or her Rights are?

No they have not validated the debt. Each time I ask for validation they say they are not doing my job for me. Meaning they think I should do the leg work to validate the debt. I don't think that is my job.

I wouldn't talk with them on the phone, you will get nowhere. Send them another follow up DV letter with a copy of your first one.

It is their job to prove they own the debt, the amount is correst, and they are legally bound to collect on it..Karen

I have been dealing with these jerks since December 06, they filed suit against me. I have requested debt validation and never recieved it. It is 8 months later and they still have not taken me to court, I have not paid them one red cent. I am demanding they follow the laws and have sent everything certified & return receipt requested. They recently answered a discovery motion I filed with them in sloppy blue marker, stating I had no right to documentation. I am in the process of filing a suit against them for violating my rights under fdca. Get everything in writing and send everything certified, return receipt requested, they will sign for everything. You will have your proof then. Goodluck

I have been dealing with them for a long time, they won 4 times by default, I was not educated on the legal process, I pay 10 a month on each one. They claim they represent the capital one, but non of my payment so far reported. I call capital one, and they have no knowledge of such attorney, they do not retain attorney after charge off. However, this time they send me one more, they dip into my CR and pick the lowest amount and demand a payment. I send them three letter of DV, no response. They manufactured the evidence, cut and past. This time, on my third letter, I inform them I will be going to the end of the line; I was stupid before, not any more. They are the worst, have no ethical or moral standard. Fight them any one. They take advantage of you , if they know you have a different name or from other country.

Was sued my WWR last fall. They said that they were hired by Capital One. I contacted Capital One and received a written statement that said that my account had not been sold to WWR. Capital One never hired WWR to sue me. I can not understand how WWR can get away with this. I am now getting legal help from an attorney and hope they will leave me alone for good.
