ok i wrote up a letter on what i want to say to the scam artist that has been calling me for a loan that i dont even have....here is goes...

What to say when the scam calls…

When asked is this blah blah,
--Yes this is she…

Automatically say sir that you are recording this conversation and that everything that is being said is in good faith.

Ask him again about the loan.
-When was it deposit?
-How much was deposit
-Who is the loan with?

After he gives you the information inform him that the information that was given is not correct.

Continue to tell him that you did some research
-The number that came up on your caller id is from a company (Cash Today) and tell him that you contacted Cash Today limited to see why they are calling you for more money but when you did call that the gentleman said that no one has been calling me because my account has been closed and paid in full.

Repeat to the man that he is being recorded and that everything that he is asking and saying is in good faith.

Ask him for his address and fax number because you want to send a cease and desist letter and also a letter to validate the debt that is being questioned.

Tell him that US National Bank does not exist.

Then proceed to tell him that he has violated laws that fall against him.

Explain to him that you contacted and filed a complaint with my attorney general, reported him to the BBB and the Federal Trade Commission and also contacting INS on this matter.

Tell him that he violated acts Fair Debt Collection Practices Act

Section 803(6) states that the collector did not give any information about the debt that is being collected.
1. Including the true identity of the debt.
2. When the debt took place.

Section 807(1-14) which states that you falsely or misleading representation.


Section 806(3) states that multiple contacts with consumer was violated.
Section 806(6) prohibits the placement of telephone calls without meaningful disclosure of the caller’s true identity.
1. Aliases
2. Identifications of caller
3. Relation to other sections- a debt collector who uses a false business name in a phone call to conceal his identity violates section 807(14). As well as this section.

Tell him that under any circumstances that you will be paying this debt because it doesn’t exist. Also state that the $300 that was collected on June 10, 2008, considers it payment in full.
Tell him that in the State of Maryland that it is illegal to collect more that what the debt is owed. Ask him if he is license to give out loans to people who live in Maryland. Which indeed it is illegal to give out loans over the Internet who lives in Maryland. Tell him that you will be contacting an attorney to further assist you in the matter if the harassment continues.
Then tell him that this conversation has been recorded and used against him. Then tell him that if he has anymore questions to send them in writing.

First and foremost, DON'T SAY YOU ARE RECORDING A CALL UNLESS YOU ARE CERTAIN THIS IS PERMITTED IN YOUR STATE. Every state has different laws regarding the recording of phone calls. Check yours before even attempting this.

Second, if you are certain the lender is lending illegally in your state, simply tell them so, cite the law shown above, and be done with it. But be sure they are illegal in your state first. If they are, tell them they are, and that you are filing complaints with the state's attorney general and the BBB. Then be done with them.

I agree with Sue. Not every state allows phone conversations to be recorded. I know for a fact that this is the law in California. But since the company is Cash Today, rest assured that they're not going to know that either--but don't stoop down to their level.
The way I would handle it with these morons is to ask for validation of the debt and when they refuse to provide it, tell them to piss off. And then file with all of the appropriate agencies--especially the FTC, since they are going after offshore places like this.

and if it is the original creditor calling (ie-CashToday themselves and not a 3rd party collection agency), then the FDCPA would not apply.

if it was me, I would not take any more of their calls. my time is too precious to waste on this garbage.
