Don't be scared! Be wise. Send them a Debt Validation Letter right away, send it CMRRR. They have to cease ALL collection activity until they provide the DV, which they probably can't do.

You may be required to pay the debt along with the attorney's fee, only if they manage to get a judgment against you. But they need to validate the loan before that.

However, if they are not ready to work with the counselling program. Then make them a settlement offer, but that too you should only after being convinced with the amount you owe.

Definitely make them validate the debt before paying, offering a settlement, etc. There's no call for them to be rude and/or threatening.

I am not even a month late with the Discover card that they are saying has hired them. I am going to send the letter then I will take it from there. I won't let them bully me and the next phone call I will notify them that our conversation is being taped. I know they can get ugly. He wanted 5000.00 down and 500.00 a month. I told him if I had that kind of money I would not be in this mess. The amount is what my Discover balance was so should I still send the letter? I think so.

Contact Discover and find out if they have turned the debt over to anybody. Try to make arrangement with them to take care of this matter.
