Can I deal DIRECTLY with the CC company? (re-stated)

Would I be able to stop collections from folks like Zwicker, etc, from calling, by sending a cease and desist letter? I have read material to indicate that if I choose, I can deal directly with the lender, i.e., American Express by sending a cease and desist letter to any third-party collection or other agency representing themselves as attorneys for the claimant. I see that Zwicker had a class action suit filed against them for claiming to be attorneys when they were actually a front or buffer for Amex. I went on disability, and the State $$ has run out. I went thru the hoops, and Fed denied the first shot for SSD. But I understand that they almost always approve those that appeal....believe me, I have plenty of proof of the "Alleged" illness. So while my intention is to pay these off, I am only able to make small payments until the appeal goes thru, or I sell a property that has been on the market for about a month, and pay them off completely. But I digress; if I send a cease and desist letter, does the collectors then have to quit bothering me, and send the note (loan) back to the makers?')

Have you tried calling the original creditors? I think if it were me, that's the first thing I would do, perhaps you can speak with them and find out if you can resume payments with them (or work out some type of payment plan you can afford). As far as a cease and desist letter to the pretend attorney, I'm pretty sure you can send them one, and tell them they can only communicate with you by USPS. If I'm wrong here, someone please correct me.

Call the creditor, if they want to work with you they will. If they don't they won't.

If the debt has been sold to a CA, it does no good to call the original creditor.

you said "As far as a cease and desist letter to the pretend attorney,...."

Does anyone know for sure whether or not Zwicker is a REAL attorney, or is it a call center (collector). I think its important to be sure of who I'm talking to or sending cease letters to.

Thanks
