I do owe money to FCNB, account being handled by a collection agency that calls many times daily and sends bogus court info. My question is, I have no money, no job, no assets - everything is my husbands and we can't afford to pay. That is the whole reason we quit paying in the first place!?!? So what can I do?

How do you know that the court information is bogus?

If you have nothing to pay the creditor then the best option you have in front of you is bankruptcy. You can apply either Bankruptcy 7 or Bankruptcy 13. But you can avoid bankruptcy by going for debt settlement. So, you should look at different debt solution methods before opting one.
