The Fair Debt Collection practices act does not make or allow a distinction fro "Collectors" and "Debt Buyers".
Under the fdcpa Debt Buyers are still considered Collectors, and governed in the same manner (as are collection attorneys) There are several staff opinion letters on the FTC's FDCPA website which make this abundantly clear. It is most clearly spelled out in a staff letter to Arbuckle of midland credit management.

In my case, in transunion and equifax--they are just showing the original creditor (fingerhut) as a 'charge off'--phillips and Cohen are not listed on it at all/nor midland. (equifax has NO collection agencies on it at all) BUT on experian, they list 'midland credit management' and it says 'original creditor-Fingerhut credit Advantag'--so they don't even have Phillips and Cohen listed and thats who I'm actually paying the money to every month. But Phillips and Cohen do have the original creditor listed on their statements as Midland credit. so I guess in this case a collection agency IS collecting for a collection agency. This just shows on my experian report though---its the ONLY report that is showing any collection agenies that are currently collecting---the other two don't show. shirley

I just spoke with a Lisa Martin from CMS (Credit Management Services) and she was very hard to talk to. At first she was really nice then started asking for info about my husband and I refused to give it to her, this is not his debt it's mine. She then got nasty stating that she was going to say that I don't want to take care of the debt and I am not cooperating. I told her that was not true, I would give her info on me but not him. She then proceeded to ask for my bank info, I explained that I wasn't going to give that info over the phone. She then said that I was uncooperative and would put that in the file. I told her that was not true but I am not dumb and I wouldn't give this info over the phone. She then hung up on me. I just laughed.

How do I email this law firm who is investigating these companies?

i think they are trying to screw w me. one guy uses different names but is the same person. he is harrassing me. what do i do?

is there a class action law suit on them?

Hank, I will suggest you to call the supervisor of Zwicker and associates and put your complaint against this person. You must also put your complaint at the FTC, BBB and the state attorney general office and request immediate actions.

B&H bought my Citibank account for under 4,000. I paid them 1,500 initially to let me make the rest of my payments through a debt consolidation program. I have paid them 107.00 each months for the past 8 months! And just last week i received a summons to court for 2,600 (including court costs). They want to garnish my wages. WHAT? After all this time and not even a peep out of them! Anyone else ever had this or a similar problem? Any suggestions?

This is good! I don't see Collection Company of America in there, looks like they've done well to keep their nose clean. I do see Protocol Recovery Service, and if these lawyers want some info from someone on the inside, I would be happy to oblige.

Hey guys guess what! I just went to that website and gave them a call! Told some very polite and interested people that I used to work for Protocol Recovery Service and all the crap I was put through, and all the lies I was told to tell people. He took my information and let me know that they'd keep it on file should anyone choose to file suit against them.

I copied the list down wow wish I would have read this alittle sooner I have had dealings with some of these ones even a couple years ago I guess some companies never change. Some now since inquiring about my CR and why they are on it. I have dealt with Arrow Fin before and a couple years ago it was a hospital debt which we were paying on but i lost my job back then and I was paying it out of my check and well i had to stop but the hospital didn't care they sent it to arrow fin and they had the balls to go down a list of ways I could pay this account with them the last one on the list was " Why don't you borrow your friends credit card and pay us then your friend could deal with a deadbeat like you." Needless to say I told him he was a arrogiate rude SOB , A jackass and further more I told him he was the most ingront SOB that his own mother is ashamed to even ackknowledge him .. well he told me that I was a B****and a **** and that I should go sell my body on the corner and give them thier money now. Well I told to him to go to hell and don't call back here, well he did every day 6 x a day even if ya answered the phone right off the top he was rude. My hubby told him one time you want the money come and get it, he'll be waiting. The calls stop after awhile and when my cousin who was only Military Police, told them that they were tracing the call and the Plice are on there way to get him.LOL But I see that they are on my credit report again and they don't list who they are collecting for this time no clue. just some xxx0624 number in the in account owner and list it as open for type of account. Haven't gotten any mail from them but will forward any type of contact to this lawyer. Keeping eye on list for any others. Thanks for the go info

Just a little FYI, these so-called collectors are no prize themselves! That may explain their behavior. At my last job I was surrounded by LOSERS who are so poorly educated, that collecting crap debt is the highlight of their career. I'm talking about people in their late 30's whose last job was at McDonalds, people living in trailers, and then these fatties would start talking about food between calls. All the while I was thinking "I've got to get out of here! I've taken a demotion and a pay cut coming here!"

pcbusdriver, the collector you were dealing with crossed all the legal lines and just became insane. Do not let them do whatever they want to. If you hold a backseat, they will again come up with something more serious in the future. Also, the company has tried to hit your account fraudulently without any purpose. They are doing it to hurt your credit. Talk to your lawyer and put a check on them.

that's right he's an ass. They can just, by magic, take control of your credit report and mark it up as they please? That's scary! They need to go to Club Fed for this.

This is the first time I saw this link on the forum. Wow, I will have to check this out and maybe add some CA's to their list like United Legal.
