They are refusing payments because I missed one. They said they would take the money out of my account but failed to say you have to go on line and set up a recurring debit. When I found out a payment was missed I called and was told it is to late we have already filed suit on 1 and are demanding payment in full. Threes weeks after I set up the plans I was served with court papers on the second account. I have and appointment with a lawyer tomorrow.

Default Collection Brutaility/Student Loans and Home Invasions

Hello Everyone!!
You all cannot imagine how my spouse and I have suffered from home invasion by allied interstate, Pioneer Recovery, DCS, ICS.
Understand that if you have student loans and your spouse like mine gets seriously ill you have the right to a hardship deferment or you may have the right to having your loans expunged.
I was never given the right. these companies started to call our home 24/7, calling our children, their places of employment, our friends, neighbors and any employer that I tried to get a job at. they ruined my credibility, reputation and I have not been able ti find employment for 10 + years now.
They called every fifteen minutes last may and my spouse sustained renal failure, was in critical condition and has not recovered.
If anyone of you have been brutalized by these companies you have a recourse!!! These companies have violatedthe 1974 Fair Credit Protection Act which was ammended in 1997, however, the context of language did not and these companies are liable to be held by your filinf their violations with an attorney and the courts!!!!
My spouse will never be the same. I have lost much but they will pay!!!

Default Credit Collection Service Threatened to Jail My Ex

Mr. M. at CCS threatened to have my ex jailed for tax evasion, although we always paid all and on time. He told this to my best friend and attempted to collect the money from her, telling her all of the above AND my personal info to boot. He negotiated the "settlement" with her. There was supposed to be $1,000 down and I could make payments. He went back on his word to me and changed the story when he spoke to my friend, collecting another $9,000 from her without ever speaking to me about it. When I found out, I had her stop payment until we could get this in writing from him. He faxed five times, but all were blank. I printed and it printed just fine. We are Cedar Fire survivors and our house still is without hot water. It wasn't supposed to take so long to finish our house, but I'm in debt because of that. I take care of a brain injured daughter - he still pulled this. It can't be legal. He even used the "God bless" line. Please, God sneezes out greater quality than this slick guy.

LJ, it appears they have violated the fdcpa, you or your ex can't be jailed for failure to pay a debt. Why is your friend doing the negotiating? DON'T EVER agree to make payments until you have it in writing! I would Send them a DV letter, make them prove they own the debt and/or have the right to collect it! I would also include a C&D letter advising them to cease contact with my friend. BTW, how old is this debt?

There are four debts. I moved, signed the house over to my ex and he agreed to take care of the debts in exchange. On Sunday, a process server was at my door for one of the debts owed. I had a heads up at that point and took it upon myself to follow up and contact everyone. Before this my credit score was in the upper 8s, and all said paid, never late. This man represented himself to be an attorney, stating that he was calling from **** Law Firm and he couldn't return our calls because he had to be in court. This to us intimated that he was in fact an attorney. He had no authorization to negotiate anything with my friend. He had agreed to accept $1,000 and I was to make payments. He was to fax this in writing. Over the weekend he collected the $1,000 from her as agreed. He said he couldn't email us the information, he had to fax it . He pretended to fax things to us, but as I said, all pages were blank. She called him for a receipt, as promised, but he told her that my ex was going to jail for tax evasion. He lied and said she offered to give him $9,000 more to "make it go away." He called my ex and threatened to lein our properties and to have things sold at a sheriff's sale. One has been for sale for six months where our house originally burned from the Cedar Fire. It's part of a trust. The other is part of a declared disaster and is homesteaded. I'm glad that my friend listened to me and stopped payment on the checks. This guy went nuts this morning, calling her nine times between eight and nint o'clock. He called five times here and I picked up on the fifth call. My ex is a cancer patient and again he threatened to jail him and slap a lein on all we own. Then proceeded to tell him that I said he was a deadbeat dad and was allowing his child to starve, and more, that my best friend told him that. My child is a brain injury survivor and three weeks ago the claw from a tractor clipped my head, causing loss of eyesight in one eye, bruising the brain stem and causing a small amount of bleeding around the stem. I called him and initiated contact when I learned it was due. I had perfect credit and care deeply about my credit. I have a horse that was given to my daughter for her physical therapy. Can that horse be sold as part of collecting a debt? She is part of the family. I'm to open a home day care soon. I want to pay everything and will. What can I do? I have to stay home because of my daughter and I'm not well myself. Should I declare bankruptcy? I just don't know what to do. Our contractor bailed out on us and we still don't even have hot water, which is required for the walk-through for the home day care. I don't know what to do. Thank you for your response earlier. It's the most information I've received thus far.

Hi,I'm sorry that I didn't back to you. Yes, I am in California. The unpolished credit collection gentleman I spoke of above won't be an issue as of this upcoming Friday. There is only one bill now that I owe and this is on a credit card through Discover. I can't pay it all at once. I was served on this one. It's how I learned that my ex (separated) didn't pay anything all this time and it's for nearly $6,500. I don't know if they will allow payments, but I'd like to go into negotiations with more knowledge about what's available before I speak with them.ÂÂ* This will be my only outstanding debt. Any advice would be appreciated. Thank you for your time.

I just spoke with them and they agreed to take payments and we will renegotiate things once the day care is up and running. They were really understanding. I agreed that I owe this and explained all that had happened, but took full repsonsiblity, as I made this debt. I thought it would be harder to talk to them. I guess that's the key; talking. i am dealing with these guys right now and i think they should be sued because i got served to go to court by these guys and when that happened i called the party they are representing and they have no record of the account on file they are misrepresenting the plantiff and i think that is fraud
