Default Debt colloector

Three diffent debt collectors contacted me. When I explained that the debt was not mine and ask them for validation I would not hear from them again. Then about ever two months after the first collector called I would get a phone/notice from a different collector. All the collectors are from different states. When is this to be consider harassment?

If you tell a collector in writing that they must validate the debt they are to cease collections until they do. You can also tell then in writing to cease and desist from communicating by any other means except the USPS. If they continue to call you after that they are in violation of the fdcpa. That is harrassment. Other forms of harrassment included calling you before 8AM or after 9PM. Calling you multiple times in an attempt to harrass, calling your job when they know these calls are not permitted by your employer, calling third parties and disclosing the debt, sending brightly colored notices or notices that make the contents obvious.

If this is not your debt, and you know it isn't, send them a cease and desist letter.

I had to do this with a copmpany years ago that got someone with my husbands name confused with us. An attorney told me to write them a cease and desis contact-that this wasn't my bill..Be sure and make copies and send it certified return receipt..KAren

Default bankruptcy sol

I filed bankruptcy 25 years ago in California. I recently received a letter from a collection agency in Michigan demanding money for a 25 year old account. What is the SOL in Michigan and must I pay?

Wow, a 25-year old debt?? That sure sounds like a bottom-feeder to me! A bottom-feeder collector buys junk debt for often pennies on the dollar and does everything it can to get any kind of payment on it.
In most places, the SOL is about 7 years, but every state is different. Also, once you make any kind of payment on it, the clock is reset and the SOL starts again. I would send them a validation letter and ask them to prove that it's yours, for starters.

wow! i hope my horrible debt issues are still not haunting me 25 years later! i have been in the good for about 4 years now i would say and im still sick about it.

No doubt. I wouldn't even have sent them the time of day, much less a DV letter. I would have told them to get lost (Cease & Desist) or I'll sue.
