Default credit report

If a debt collector buys an old debt can they report activity on your credit report when they take the debt over? I ask this because I have an attorney that has collected money from me on two collections one I am still paying on I have a feeling he bought another debt. I believe that the statue is or has run out but when I look on my credit report all of a sudden it was reported on in 2009 like they are waiting for me to pay this one off and come after me for the one that the staue has run out I guess when does the sol start? Is it from the last payment made or the last activity on your credit report? If they can continue to report on it how can the statue even be a factor? This debt started in 2000 and last payment was made in 2002. oh yeah I live in michigan and I know the sol is 6yrs. Any info will be a help so I can be prepared.

SOL refers to the amount of time they have to legally sue. It normally starts with your last payment. Do not confuse it with reporting time limits. Federal reporting period is 7 years + 180 days from the Date of First Default. That is the date that you missed your first payment and never brought the account current again. Once 7.5 years has passed, no one can legally put it back on your reports.

well legally, the account is only allowed to be reported 7 yrs +18- days from the date of first delinquency(DOFD). That date can not change just because its shifts from one collector to another. Check it out in the fair credit reporting act. Is this showing on tu file? Usually they will show the deletion date which is 7 yrs +180 days from DOFD. If its not reported accuratley, dispute via certified return reciept snail mail and it may go away..Just hang tight other readers will give you more info than i have....

So if my last payment was made in 2002 than even though they are still reporting it the statue starts from the last payment made? Contact has not been made by the attorney yet I have a feeling he is waiting because he has a judgement against me right now and if I do not pay he can garnish me and he can not garnish me on two judgements at the same time. So should I wait until he sends a letter before I send a letter stating the statue has run out? I am making insallment payments on the other judgement but if I miss he will garnish (he already has). Basically if I continue to make payments it will put this other debt further away from the statue.

The SOL clock began ticking in 2002 so this debt is out of Statute. You have no legal obligation to pay it. If it originally defaulted before 11/2001 then it shouldn't even appear on your credit report any longer

How do I find out exactley when the last payment was made? I know it was no later than 2003 but I want to make sure.

You will likely have to dig back thru your financial records but you may be able to get that info from the OC. Failing that, if it is not showing on your credit reports, I would dispute the tradeline as "Multiple Inaccuracies/ Verify all data fields". The FCRA states that your credit reports must be complete and accurate. If they show a "N/A" or "unknown", that is not complete.

Going through my credit report it shows this debt twicw from the same oc it has the same last 6 digits for the account number but difeerent begining numbers. Also a different amount the first is 2700 as unpaid the second is showing 3802 how is that?
