Sorry about the double post, I posted last night as a guest but I cant seem to find my post now.

I am being threatened by Cash Transfer Centers that my payroll will be garnished if I don't pay them back.

In doing research on this forum, I have discovered that they are operating illegally. Put that aside, I still feel that it is right for me to pay them back but they wont offer me any DOABLE repayment plans.

I also understand that they cant garnish my wages without taking me to court and that I need to submit a letter to them and to my payroll to alert that I was scammed into signing this payroll garnishment.

QUESTION: Does anyone have any sample letters that I can use that state the following

1.) I do not accept the payroll garnishment
2.) I do not allow them to contact me at work or at home or my references. They are only allowed to communicate with me with USPS.

Any help would be appreciated.

They use wage assignment not garnishment. They can't garnish because they are an illegal operation and would not set foot in a courtroom in the US. A wage assignment is voluntray and you can revoke it. You should go to tyour HR person first however because they are very fast to send that letter. Your company has no legal obligation to honor it and they must know that. Search this site for there address. They have a call center in British Columbia but their office is in Malta. It will be easier to stop it at this end. They will probably ignore any letter you send them.

Unfortunately pdl companies don't have to follow the cease and desist rule. But if you put a request in writing and if they are not following the laws, you should file complaints against them with the attorney general of your state.

There are many complaints on CTC about their illegal business. They are very quick in sending the wage assignment to the payroll. Make sure that you notify your payroll in advance. Send a revocation letter to their mailing address.

How much is the loan for and how much have you paid so far?

All you have to do is right them a letter stating

"I revoke any and all wage assignments I may have signed with Cash Transfer Centers."

Oh and add any of they other affiliates....they may try to submit it under a different DBA!

That will be nearly impossible! These companies tend to have more than 10 different DBA's and it is nearly impossible to find out which ones belong to whom.

They may also attempt the wage assignment even after sending the revokation letter, that is why it is important to give a copy to your payroll department. I have seen posts where this company has went ahead with the wage assignment even after it was revoked. Twisted Evil

First things first, notify your payroll department before Cash Transfer Centers gets to them first. They will try more than once to get ahold of your HR department and execute the voluntary wage assignment. That is CTC's favorite thing to do. Then after you notify payroll, notify CTC. They wasted no time at all contacting my HR department but I beat them to it. Make sure you file that complaint with the AG. That is the only way we are going to stop these illegal companies. My AG was a huge help in getting this company off my back and marking my account PIF.

When you do your letter, you might want to include these DBA's, since they might try and be sneaky and use them:

Northway Debit
Sonic Payday

These are the names of other companies that are related to CTC that also use the voluntary wage assignment letter

A voluntary wage assignment letter is one that you would sign allowing the PDL to garnish your paycheck should you default. Not a good thing to sign, obviously.
