My son 18 at the time joined Ballys the sales person who signed him up new he was joining the Army and told him not to worry that the contract would cancel if he sent in the deploy papares which he did..1 year later mu hubby and I signed up for a month to month with Ballys they have got my husbands name and SS# and have pinned 3000.00 dollars on him because my husband and my son have the same name except for the middle name/We have explained this to Avante many times and they said they do not care they will ruin my husbands life and credit they have have been calling my husbands work place and cell# saying its him and they keep repeating the ss# and threating they will keep harrassing till we pay them 3000.00 can anyone let me know if I can get a lawyer for this?

CAUTION!! Avante is NOTORIOUS for NOT being licensed & bonded to collect debts in various states. Before sending off your letter, be sure to check & see if they are in fact licensed & bonded (if your state requires that). If they are not, add that info to your letter. Add something like, "Despite that fact that you are not licensed or bonded to collect debts in (state), I am sending this letter to protect my rights. You have been reported to the Department of Commerce in (State)."

You can check if they are licensed by going to your state's Secretary of State website. Also, a quick google search will tell you if your state requires licensing. Hope this helps.

I worked for this company a couple of years ago and I can tell you that as a company they do, in fact, try to follow all the rules and work with people on their debts. Some of their collectors are inexperienced and believe that the best way to make debt collection calls is to threaten and talk down to people and that is unfortunate. If you have a problem with the way you are being treated my suggestion is to ask to speak with one of the managers and explain your situation to them. Jeremy Moore is the manager over all of the collectors and is always willing to listen and help.

My newphew went to Ballys just as a visitors and wound up getting harrassed by Avanti by a Mr.Williams which keeps telling him he owes Bally for the contract he signed and he did not sign any contract with them all he did was to attend the courtesy for the week Bally had given him and signed the week notice they require. We are not going to be harrassed at home because of Avante USA trying to collecto on some person who ever that maybe get your information correct IDOITS!!! Because you are not collecting one Penny I'm reporting you to the BBB.

Excellent! Join the other 48 people who filed a complaint. Although they haven't been sued for quite a while, only 2 - 1 in 2008 and one in 2006. If they act in violation of the FDCPA, and you sue them for it, the $1,000 civil penalty is payable to *you*.

Also file a complaint with the FTC, your state Attorney General, and the Bureau of Consumer Affairs.

Also file complaints against Ballys.

You may want to look at both the FTC website to better understand you rights on these debt collectors. I know for a fact this particular company had done some illegal activity in the collections as per the Fair Debt Collection act. Below is a link of FAQ for the FTC.

Be aware that under Privacy laws they cannot be repeating your husbands SSN#. They can get fined big time for that. You can probably google Personal Identifiable Information laws to learn more about that. Also contact you state District Attorney's office and the BBB to report they are using your Husbands SSN during calls repeatedly.

One more thing there's always information on these people on a website called Whocalled.us. Just put in the phone number from. I always find alot of information from others like you and I who get harrassed by unrequested callers that usually turn out to be debt collectors or some type of sales mostly like pharmeceuticals.

Im getting calls from this company like 3 or more times per day! And now they started calling to my job. It was because of a bally "3 yr contract" that was suppossed to be a month by month contract. At bally they never explained why they change the contract terms. I could never get a hold of bally. I sent letters and more letters to cancel the contract and they never answered. Even my 14 year old sister was included in the contract without permission of parents under the responsability od an 18 year old. I really don't know what to do. They are charging me $2300!!! It is just unbelievable!

Called me today and informed me they were collectin g on a debt from Radio Shack - opened in 1994 and closed in 1997. Told them to contact my attorney as all debts were included in bankruptcy in 2004. Manager tried to tell me that unless it was specifically mentioned, it wasn't and I needed to pay the bill. He called my attorney and told them it was closed in 1999. Can't get dates right on the account. Would not tell me any information as to the account origin. Pulled Experian and Equifax - not ONE mention on either of Radio Shack OR AvantUSA. If my attorney find out what I think they will find, I will have a HUGE lawsuit for these people.

How bout I have perfect credit... no credit cards or loans and just got my number last week and these people start harrassing me!?!?! And they don't talk to you, I answer and it's automated saying call me at this # then that's another automated POS...
