I received a call from CSC the other day about a debt from about 2 years ago. I was told very abruptly that if I did not settle my mastercard account with them that day, that they would file a 1099C with the IRS. I thought in order to file a 1099C with the IRS, the last payment had to be over 3 years ago. This is not the case, as a payment was received in November of 2007, not even 2 years ago. I do owe the debt but cannot pay it and will be filing bankruptcy. I lost my eyesight and went on Social Security Disability the end of 2005. I kept up with the payments as long as I could until the medical bills became too overwhelming. I lost my home and everything. I will be filing bankruptcy soon and told them this. They said that they will have to work out a payment plan with my bankruptcy attorney as I can't file bankruptcy on this account because they are filing at 1099C. Which until now, I had never heard of a 1099C. I am insolvent, blind and only receive ssdi so I wont have to pay taxes on this amount, but from what I can tell, they should not be filing the form yet anyway. And I am sure if they do file, the burdon of proof will be placed on me. Any help would be appreciated. By the way, I live in Florida.
