There are two options a debtor in Florida can avail. One is a debt consolidation loan and the other is a debt consolidation program.

In case of a debt consolidation loan, the debtor is able to clear his debts all at once. The different debt accounts are replaced with a single account. A loan is applied for depending on the outstanding balance and the pending bills are paid off with the loan. The debtor is required to make payments to one creditor only.

A debt consolidation program helps in combining all the debt accounts into a single account and then pay off the debts over a time period. Under a debt consolidation program, the repayment time is rescheduled as per the debtor's requirements. Usually the debt consolidation company negotiates with the creditors keeping in mind the requirement of the debtor.

A debtor, who is deep in debt, cannot avoid the wrath of the collection agencies. There have been several instances when the collection agencies indulge in unethical activities and harass debtors with the hope of extracting some money from them.

The collection agencies send letters and notices to people asking them to pay up and sometimes they also ask for payments that have already been made. Under such circumstances, the debtor can always opt for debt validation. Alternatively, a debtor can also see if the SOL or Statute of Limitation is applicable on the debt or not.

In Florida, the Statute of Limitation for -

  • Oral Agreements is 4 years.
  • Written Agreements is 5 years.
If the SOL on a debt has expired, the debtor can use it as a way to defend himself while dealing with the collection agencies.
