Calling at 7am and 10pm is an fdcpa violation and multiple calls outside legal calling time is worth $1000. Take a picture of your caller ID and demand your money!!!

She has no right to speak to you like that vicson22. In fact she violated the Fair Debt Collection Practices Act in doing so. Also you cousin cannot be charged with any crime or imprisoned, which threatening to do so is also a violation of the fdcpa.
What state do you live in? I would like to check your state's statutes to see if you can legally record phone calls without the other party's knowledge. Even if your cousin does owe a debt, disclosing this information to you is also a violation. In the mean time send them a letter instructing them not to contact you by phone anymore. Send it certified mail, return receipt requested. Here is their contact information: allied interstate, Inc.* 435 Ford Rd. #800 Minneapolis, MN 55426-1066 Phone: (952) 546-6600 1-800-806-3342 1-866-525-7795 Fax: (952) 595-2311 |

I used to work 3rd party collections. I scoffed when I read about people who reported agencies calling their bosses or relatives, or calling early in the morning. I just simply did not believe it.
I stand corrected. Allied has called my work numerous times in the day, even after being told repeatedly not to call. They refuse to call my home number. They have said, "I'll call you at work as much as I want until learn to pay your bills." When they threatened to call my boss, I thought it would just to be for employment verification. Nope. Three days later, he calls me into the office, shuts the door and says, "Your creditor called me about your bill, saying you gave them permission to talk to me and that we'd pay. If they keep calling--you're fired." He also offered to document the call so I could forward the log to the FTC and attorney general. They have ignored my DNC demands, and will call up to ten times in a day if they're in the mood. If they're unconcerned about the law so much that they'd actually call my boss, I wonder what other tricks they'd be willing to try? |

mozart....if I were you I would be finding a NACA attorney...you have one hell of a case with the 3rd party disclosure to your boss.....embarrassment and worrying about loosing your job pays quite well in terms of a settlement.

If you're boss will swear out an affadavit, you definately have a case. The FTC would love to see this since they've nailed Allied on numerous occasions.
