Well,I was just saying to someone else in the forum tha NCO was the only CA that was decent to me and let me make payments. Wellll-I got a call from them about my son's account,who is on disability. They told me Discover charged it off 1999,and they got it 2000? Well I explained he is on disability,has been for several years,got these cards back in 1995(?) and hasn't used them since 6 or seven years. He will be on disability forever,blah,blah. They said they don't care,they are goin to do a wage garnishment and judgement on him. Am I right or wrong thinking they cannot attach a wage garnishment on disability?I'm pretty sure these are out of SOL period,but,unfortunately, on one of his bills,can't remember which one, a few years ago I made a payment-this was before I knew better. If anyone know for sure about the disability thing I would appreciate it Very Happy ...Karen

That is a good question....I would like to know the answer to the SOL as well.

Does the time begin once you stop payment or at charge off?

You will have to check with the laws in your state because garnishment differs from state to state.

In general, only child support, student loans and some government debts are taken out from disability. Money can't be taken from disability for any other accounts. Your SSI also can't be taken.

Besides, the debt seems to be out of the SOL period. Confirm it with your state laws. You will need to notify them in writing if the debt is out of the statutes.

Linda, SOL begins from the date of last payment activity in your account. A charged off account can show some payment at a later period. In case, the SOL is expired, and you pay something now, the SOL will again get renewed from this date.

Thanks Gretchin-I was going to send them a letter stating it was out of the SOL,and the idiot REFUSED to give me their address!!So if anyone knows the address,I would appreciate it...Karen

you would need to know the date the last payment on the account they are collecting on was made then find the SOL for your sate and go from there. without knowing your state,or the date of the last payment made on that account, we can't tell you when the SOL was up. However, disability/SSI can't be garnished for this purpose, however they could get a judgment (if still in the SOL) which would make it easy to get all or a portion of any non-disability/SSI wages, tax refunds, etc. If you get a summons or notice about a hearing, make sure you and your son show up at the court (or your attorney) Failure to show will likely result in them getting a judgment regardless and the SOL being renewed.

Thanks for the info,Clay. I live in Oklahoma and he has no other income,no tax refund,etc, other than the disability. I want To send a DV letter,but he refused to give me the address or any acount numbers,so I am not sure how to do it now....Karen Crying or Very sad

Nco has several offices. You would some how need to find out which office is Servicing the account.

That is the address that I have listed on my credit report (they are no longer there, I gave them the boot, but they are still listed under the "creditors")

If they are listed as a regular acct then this is wrong. They are like Arrow, because they bought the debt they think they can report like the original credtior. I had Arrrow removed fairly easily by notifing them that they are violating FCRA.

Thanks,all. Lessis more-good idea,I did call some attorneys,but those I called had no idea!I'll wait until after the holidays and contact some more. One attorney said they could garnish disability if the charges on his credit card weren't for needed living expenses. I explained that these charges were from late 1990's and my son doesn't even remember how or what he charged. Plus they keep hanging up on me(NCO) so I can't get an account number,address,nothing....Karen

Sorry Lefty (are you really a lefty? I am!!), I should have typed more clearly. They are still listed under the area of my TrueCredit report that shows the creditors/collection agencies I have/have had accounts with. It's like an extra little service that they provide as a "convenience"...LOL...not very convenient to me.

And everytime I try to talk to them,they hang up and still refuse to give an address.I am goin to try to talk either to an attorney or legal aid to see if they can touch his disability if they issue a judgement,like you said,I'll then file a hardship for him if they do.Thanks for your help Very Happy ...Karen
