Someone please help me.

I just received a call on my office phone from a woman who only indentified herself as "Worman" (a last name, I guess?) who proceeded to tell me that she represented a loan company I borrowed money from (a pay day loan place) and that she was calling to inform me that they were going to file charges for "malicious intent to defraud a loan company" and that they were going to send someone to my apartment (she had my address) to depose me on the spot. She asked for my attorney's name, I told her I would have to get back to her, and she said "good day" pretty rudely and hung up the phone. She never told me who she worked for or what I could do to resolve the situation, and now I'm sitting in my office crying because I'm terrified. Anyone with any advice, please help me.

Is this an online pdl or a storefront? All they can really do is sue you civily. They can't have you arrested or anything like that. Tell us a little more about your situation so we will know better how to help you. Also, if you register with this site a credit counselor will contact you to help.

Don't panic, we have all had these harrassing phone calls. Did you get a number or anything from caller ID. She will be probably call you back but you have to take control of the phone call and try to get information out of her. Don't let these people scare you, they can not threaten you with arrest or send somebody after you. When I received a phone call similar to this I pretended that I was going to send a money gram or money order so they would give me information and that is how I found out what company was calling me. Did you have a Payday loan that you defaulted on? Do you remember who the loan was from?

Ashley, I guess a collection agency called you up regarding this debt account. If you don't want to work with them, send a cease and desist letter and mention to contact you only by mail. The company must stop calling you after receiving your letter. Send your letter through certified mail with return receipt requested. In the meantime, try to contact the loan company and get the problem fixed with them directly. If this debt is legitimate, you need to pay them and get off their list.

Do not get too worked up over this. Yes, it was frightening to hear somebody say your address and they will send someone out for you. I would be willing to bet is just part of their slimy collection tactics. Remember this---if it was a real "legitimate and operating legally" company she probably wouldn't have hung up and she would have gotten more information from you. Legitimate companies WANT to at least get some type of payment commitment from you.

Agencies like this are rude, unprofessional and down right nasty and their number one weapon is: fear

I think just about everyone here has dealt with scum like this. My suggestion to you is first, pull yourself together. Don't crack for these people, don't tense up everytime the phone rings. You have the check book, you are in control. Let them know you won't be bullied by their illegal methods.

If at all possible, go through the original creditor and don't agree to anything with out having something in writing.

Remember you are in control, if she refuses to act humane, hang up. No one can arrest you, take you to jail or any of that nonsense. does your company record phone calls?

Could you let u know the company you borrowed money from and the ca?

I'm not even sure who she was "representing" (and I use that term loosely). She never said who she actually worked for or which company she was claiming to be representing, she didn't give me a first name, and when I called back the 1-866 number she left with me, it went straight to an automated voicemail system. Trying to deal with the online payday loan places, has been horrible. The other thing that she said on the phone is that they were going to send someone to my apartment to do something with paperwork, and then "depose" me on the spot. I don't know too much about laws and such, but is that even legal? I don't even know how I'm supposed to try to fix this if she won't tell me who the problem is with.

Have you defaulted on a payday loan or any account that you think might be in collections by now? If it's a collection agency they can't send anybody to your house it's illegal. It's also illegal for them not to tell you who they are.

I didn't think that I had, but I guess it's possible that I missed one when I was signing everything up with T and C. I don't know if that's actually the problem or not, since the woman never gave me any information, but if I did default on one, can I still sign it up with T and C? If she's not with a collection agency, who else would she be with? Can they actually file criminal charges against me or anything?

Ashley, take a deep breath.... next time she calls, which she probably will, tell her to deal with T & C. Go and make sure all the pdl's are listed on your contract with them, if one is not, then add it. They will let you do this, but your weekly, bi-weekly or monthly payment will go up a little. I would almost be willing to bet that no one will show at your door. This seems to be a common scare tactic that collection agency use to frighten people into paying. Also, tell her you would like validation of the debt that she is trying to collect, this seems to make some of them stop calling. If you can, send the company she works for a cease and desist letter, that way only the original owner of the debt can try to collect from you. When you get time, pmme with the names of the companies your are trying to work stuff out with, if you want to. Stephanie

I don't know about T&c but with the two companies I worked with, they allowed you to drop and add anytime during the program.

I have two other payday loans that I've been paying off on my own; I have paid back way more than I originally borrowed. I read the letter that someone posted on this website about violating Texas state usuary laws and interest cap laws, and how they payday loan places responded back to a couple of the people by marking their accounts "paid in full". How do I find out if a payday loan place is licensed in TX or not so I can try sending the two places I'm paying on my own that letter? And to everyone who has responded to me so far, thank you so much for your support and reassurance, I really need it.

That is what I would also like to know I have tried to research this and dont know what Im looking for exactly I did email one of mine and they out right responded with this

1. Cash Direct Express is a lender licensed under the laws of Delaware

2. Cash Direct Express is not conducting business in the State of Texas

3. Cash Direct Express does not maintain a location in the State of Texas

Hmmmmm Then they proceeded to tell me that I have to go by there laws etc and the state they are licnesed to do business in
I have not been able to pay mine down at all since the fees are killing me but I sent T & C the paperwork today and I will send them the money Monday to start tackling this consolidation for me and I did close my bank account today so we shall see
