Collector from “in house” collections, not a third party-keeps calling me and finally told me that he was going to come to my house and kick my butt. He used terrible words then I just used here. And he keeps calling. The thing is he wants to collect a debt from a relative of mine. I keep telling him he has the wrong person but he says I'm lying. Which I'm not. He calls all the time. He doesn't tell me his name or who or what just to pay the bill. He threatens to beat me up, come to my home. I filed a police report and that is where I am. Help?

You did the right thing in reporting the matter to the police, but still, contact your local attorney and get your latest credit report too, request the CA to send you everything in writing, since you are not the one but a relative who actually owes the money, make sure it doesn't show in the credit report, but if it shows, dispute it and mail a copy of the dispute letter to creditors company immediately.
Try to tape the caller's voice from the CA and note down the time and date. Once you start recording those threats and harassment calls, you can mail them a cease-comm letter, if the threat and harassment doesn't stop, take them to court and if you could prove their mistake, the final judgment could be in your favor and the CA could end up paying you .

I have had the same type of experience with these people! I have disputed the amount with the credit bureau, won the investigation, and they still call. Today the guy would not give me their mailing address. My situation is three years old with them! I have called the police, like an idiot, they don't care; I should have called an attorney. I have sent them certified letters of the past three years! They ignore them and just call and call. Today the guy argued with me for 15 minutes and refused to give me his mailing address! I have requested copies of the phone conversations, and then they hang up!

It is highly illegal to use such language while collecting debts, be it your debts or your relatives.
According to the Fair Debt Collection Practices Act (fdcpa) practiced in the United States of America, a debt collector is highly prohibited from using abusive or harassing language while collecting debts. He can neither threaten nor use any illegal means to extract the debt.
Moreover, a debt collector is also highly restricted to harass or abuse any third party regarding a debt issue. All he can do is enquire the third party about a debtor's residential and work address.
If the debt collector is behaving in an illegal manner the debtor or the third party has full right to sue the collector for the violence of the FDCPA rules.
So be calm and make the collector know that the law is at your side.

maybe these gamblers and their postings should be banned, this site provides solution with our debts, who needs gambling and gamblers ! ? Sigh !!! hope they dont come in too often ..

This site is trying to do good to the community who are struck in debt and some people related to casinos sites are tying to disturb the atmosphere here looking for their own personal benefits. I ask the casino owners to do their marketing in their own related topics rather than disturbing the people who are already struck in debts and seeking for some solution. They should not be tempting such people who are already in between their miseries.

You can call the company's customer service, or the supervisor of the collection agency in order to find out who called you that day. the telephone numbers are computer generated so they do keep some kind of record of who calls you. You can also ask the bill collectors to stop harassing you. I think that you have to put it in writing. If that doesn't work, you should contact a lawyer and sue the pants of this company. The law is definitely on your side.
