Welcome to the forums. Firstly, as the collection agency, Allied Interstate is saying that the last activity was seen in the year 2000, please ask them to validate this debt as you have the legal right to know the details of your debt.
Secondly, as per the FDCPA, the debt collectors are restricted from using unfair or illegal collection tactics. Please follow these tips when you are dealing with the collection agents.
- Never get intimated as your rights are protected.
- Before you enter into any sort of agreement, get everything in writing and keep proper records.
- Your decisions should be based on payment amounts and intervals and not on the collectors.
- Always report the Federal Trade Commission when they treat rudely or cause harassment.
- You are not required to pay through post dated checks or by automatic withdrawals.
- Never get bullied by the collection agents.
In your case, if you are sure that the SOL has expired, then Allied Interstate collection agency can only bark and not bite for recovering the debt. Even if they take the case to the court, the judge will have to dismiss the case on the grounds that the SOL has expired.

I, too, have been getting harassing phone calls from Allied Interstate. I've asked for confirmation of my alleged debt in writing and was told they do not put anything in writing. I then proceeded to tell them that I was in the middle of a bankruptcy and they needed to call my attorney. The person ("Charles") yelled at me and said that my attorney needed to contact them. I hung up. They continue to call. In the State of Virginia, it is against the law for a collection agency to continue to call someone who has filed for bankruptcy. Is this happening all over the country with Allied Interstate? They are, by far, the rudest and most unprofessional company I have ever dealt with. To FryPenguin or any victim of a junk debt buying CA
A. When Allied Interstate say they don't put anything in writing read that as we can't validate this debt and don't have a leg to stand on. We are trying to bully you into paying and its all we got.
B. Just because they don't put anything in writing does not mean you can't. Find a copy of a good debt validation letter on this or other web sites. It will include a do not call me clause. Send certified mail rrr to CA. At least the $4.42 will buy some freedom from being called. ( If Virgina is a one party State you might be better with option C. )
C. Find out if Virgina is a two party or one party recording State. If Virgina requires the consent of both parties to record a call, get a phone recorder, politely inform Allied Interstate you will record the call. Don't forget to start your stop watch but be quick--you will shortly hear them hang up. And not call again.
If Virginia is a one party State and only requires the consent of one party (you) to record a call, just start the recorder when Allied calls you, don't warn them, just keep them a blabbing away. Be very polite yourself and act confused. Then take tape to lawyer, they will tell you how many Thousands of dollars you can sue them for with a guaranteed win in court. Of course they may call again and the next tape will be worth some more money. Who knows, maybe they will be so generous that they can get you solvent without bankruptcy. And here I thought those junk debt buying CA's fufilled no useful social purpose.
Just wish my issues with a junk debt buying CA was that simple. They are easy to chase away, its the damage they leave after the visit. _________________ Register today to encash debtcc points. |

FyrPenguin, when your collection agency says that they are not required to put anything in writing, they are violating the law as per the FDCPA act.

� Prove the Statute of Limitations has not expired on this account
� Show me that you are licensed to collect in my state

� Proof that the collection company owns the debt/or has been assigned the debt. (You are legally entitled to collect this particular debt from me.) This is basic contract law.
� Complete payment history, starting with the original creditor. (I need to have proof of my payment history with original Creditor, what the amount of the debt was when the creditor assigned the debt to your company, and what fees/interest has been tacked on to this debt and how you/they determined these fees.) This requirement was established by the case Fields v. Wilber Law Firm, Donald L. Wilber and Kenneth Wilber, USCA-02-C-0072, 7th Circuit Court, Sept 2004..
� Copy of the original signed loan agreement or credit card application. (My contract with the original creditor establishing the debt between us.) This is also basic contract law.
At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau's (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent
I will not hesitate in bringing legal action against you for the following:
� Violation of the Fair Credit Reporting Act
� Violation of the Fair Debt Collection Practices Act
� Defamation of Character
If your offices are able to provide the proper documentation as requested in the following Declaration, I will require at least 30 days investigating this information and during such time all collection activity must cease and desist.
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.
If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.
I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.
It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records; any information obtained shall be used for that purpose.

Once you send this letter through certified mail with return receipt requested, they are required to validate the debt and stop all modes of communication with you.

I keep getting phone calls from Allied Interstate for some other person. I have called them 4 times to take me off the calling list and that no one lives here by that name. Well the first and second time they were ok but the third time they hung up on me. I called back and they started to raise their voices. I told them they need to stop calling. They leave at least 2 to 3 messages a day on my voice mail. What can I do for them to stop calling me. I have a feeling they will call again. How can I make a complaint against them. Welcome to the forums. As per the FDCPA law, the collector is not prohibited from calling any person if they are trying to recover the debt. They are using means to locate the person and this sometimes results in calling the wrong person because of inaccurate information and record-keeping as it has happened in your case.
Please send one written letter to them explaining your cause and after receiving your letter, they are required to stop all the collection efforts. If they continue to call you after you have informed them, it is serious violation of the law and needs to be reported to the FTC Consumer Protection Cell.

i have gotten daily calls from Allied Interstate for two months now and finally got a letter from them, including three different addresses, and finally the fourth to send the money that I did not even owe. The form did not even fit the return envelope. Yet I sent them the $13 in bills, for which all I have copy of, just to get rid of them. But, yet, something should be done about it all. I have all my documentation about all this business, and also told the last representative I angrily blasted to, from India, nevertheless, myself being from Finland, that he better get off that company, before all business was over from them, and I will promise that it will be over soon. I hope they return my $12.42, including a tip for $ 0.52. They must have paid more than $ 300 in long distance calls from Ner York (?) to Michigan fraudulently trying to collect the $12.44 which I never owed. Welcome to the forums. Did you see the status of the said account in your latest credit report? Please pull your reports from the three bureaus in order to confirm about your payment made.
You also need to contact the company which is asking you for payment. Please provide them the necessary information with the photocopies of all your payments made in regards to the said account.

I too am receiving calls from Allied Interstate nearly on a daily basis. The person they are calling for does not even live with us. I have told them this but they will not stop calling. In fact I think it has gotten worse. Does anyone know their mailng address so I can send them a letter to stop harrassing me? Thanks for the list of phone numbers of the collection agency - Allied interstate!!
After looking at the various numbers, I think you may have provided me with the needed information on an Unavailable number, that showed up on CallerID a while back. Number I was getting was (480) 722 7820.
Is it possible that this is another number
used by AI, Chandler, AZ??
Luckily, I never answered the phone, simply because I did NOT recognize the number. And because I was sound asleep at the time of the call(s). Phone ringer and answering machine turned OFF as well. For obvious reasons.

They call me from 952-582-4735 They call everyday today I went off on the girl I actually called them back. I did a check over the phone last night but that turns out to be a different agency. These are both medical bill's that I have been paying on but still went to collection. She is telling me I never paid on this bill since day one. I just paid 100.00 July 2005 to the hospital, so it really ticks me off that some little snot nose kid that can't find a better job is saying I don't pay my bills. I really lost it but I'm sure they will still call. My home phone is also my business. She insists they sent me a bill in the mail. Not ever once have I recieved anything from them. I would just like to pay the hospital and not the collection agency. I would also like them to stop calling me while I'm flipping hamberger's. Any idea's.

| What happens if I don't pay this bill? Will a collection agency like Allied Interstate Inc. settle for a reduced amount. One Co. is telling me that if I don't pay in full now this will go on my credit report for 7 years, is this true? I'm in WI. Do medical debts have any real bearing on your credit report?
