Yesterday Ellis and associates called my husband at work and told him that we owed a payday loan debt. I called them yesterday and left a message and they never called me back. I called them today and the lady that I talked to said that they could not give me any information but I would find out in court. We never got the payday loan so why are we being suid for something that we did not get?

Welcome to the forums. Please do not get tensed about the calls from Ellis Crosby about the alleged debt. You can read this forum and acquire more information on how to deal them when they call you next time.

Also, it is suggested to pull your latest credit report from the three bureaus and know your latest credit standing. It will be helpful to know the details of your debt accounts.

Thank you for the advice. We do have a recent print out of our credit report. The only problem is that they have already threatened to sue us and that pissed me off. For one, they have no right to threaten anyone with a law suit. She won't even give me any proof of the paper work they have. I have called the company that they said we had the debt with and they don't even have us in the system anymore and the bank that they said funded the loan has not done a payday loan for over three years. I have done my homework on this and we are prepared to fight them to the end. If they take us to court or if this shows up on our credit report then we will fight it and we WILL WIN!

This is the perfect move from your side. Use your consumer rights as per the fdcpa law by asking for debt validation whenever these harassing calls are on the rise.

You can also record all the telephonic conversations held with them so that you can present it to your lawyer and take legal action against them. Be rest assured that Ellis Crosby will not take any legal action against you as they are undergoing legal surveillance.

You can also send a cease and desist letter stating that you refuse to communicate with them and they are required to follow the rules as per the FDCPA law.

Making your strong move further, you can add to the consumer complaints against them at the FTC, BBB, DA's office and request immediate action.

I just recieved another phone call from Ellis Crosby. He wanted to know where my payment was. I told him i was advised not to send any more money to them because they were suspended and the money i was sending wasnt going to where it was supposed to be. I told him what he was doing was illegal because I have sent a cease and desist letter to ellis crosby certified mail, and then faxed them a copy of it so they would have it on file. He said that what he was doing wasnt illegal, that they are not even members of ACA. I asked him why he told me he was from a lawyers office and why he had told me that there was going to be a felony warrant issued for my arrest. He said he never said any of those things, which is totally untrue, I remember what he said because it had me so upset i was in tears over the whole thing. He told me that all conversations were being recorded, I told him that was great that he could review his tapes and see what he actually told me. He started being kinda nice until I told him that I was not sending them any more money, then he was very rude, yelling at me, and laughed and said "you are such a joke!" Can you believe that?? He then hung up on me, what should I do now?? Do i call back and go postal on a supervisor or what? I have filed all of the complaints I think that I can. He had no right to talk to me that way! I am so sick of these fools at Ellis Crosby!!

He also said that I was slandering him by saying all of these "untrue" things. What do you do when someone like that is so rude and mean. i dont want to get myself into any trouble by slandering him, but I'm not, everything i repeated back to him was only what he told me. If anything, would he be slandering me?

Ashley - Do not feel sad and think about this phone call. They will not slander you for anything as they don't have any legal powers to do it.

As you have done your part of the job by filing all the necessary complaints at the different government agencies, we are just hoping to see some quick action against them.

You can be rest assured that you have your consumer rights protected as per the fdcpa law and you are not involved in any sort of violation of the law. Keep smiling

I'm still curious to know if anyone knows if Ellis is licensed to collect debt in the state of Illinois?
I've heard that where they are licensed to collect is irrelevant if they are doing so via mail, fax, or phone....

Even if they aren't licensed in Illinois, are they still able to collect debt from me because it is via phone, fax, blah blah blah? If I'm to make a case against these people, I want to make sure I know what I'm saying...How could I find out if they are licensed to collect in IL.?
