I received a call a in Jne with the same threats. They said I owed ove 900.00 and need to pay or go to jail. I freaked out and called a friend, borrowed $400.oo left work and sent it to. I get a call Friday and the tell me I still owe 945.00 even after I paid them 400.00 and if I didn't pay I was going to be arrested. I didn't have it so Miss Shaw let me pay 100.00, then 300.00 or the balance of 845.00 today. I see this forum and I still am unsure of what to do.

I was willing to pay my loan back, but eca never attempted to contact me until they said i had 2 hours to pay my debt with was $200 more than what I owed. They said they sent out certified letters to my address which they did not, they said they called my work and left messages which they did not. I was willing to pay my debt and I did but they didnt have to threaten me with throwing me in jail. I have always payed my debts. So you need to get your facts straight before u start calling people thieves. You want to bring the Lord in this, he didnt give u the power to make yourself better than everyone else and to call anyone a thieve or anything else

Folks:

After reading that news article and the harrassment that you have all been through I think you all deserve to be paid something for you troubles. Let's face it....Big Business always seems to get away with things all te time and its the little people that struggle each day to make ends meat and then Big Business wants to take even more away from you. I hope you guys win the case. It would be nice to see things change for the little guys for once. I just have a funny feeling that what could hurt your chances of winning a settlement is if Ellis Crosby files for Bankruptcy. To be honest with you, I'm not sure what company you took out the loan with but the charges they must have charged you are ridiculous. It should be the loan companies to blame not the borrower. If these loan companies chose to do business with Ellis Crosby then they should suffer and not be compensated either by the borrower. It's time Big Business should suffer. If I were in any of your shoes i probably would take any form of settlement won (if it happened) and most likely not even pay the loan company to make them and Ellis Crosby learn a lesson.

Yes pzblake, you are right. The borrowers were all helpless lemmings who didn't know the terms of the loan and followed each other right off the cliff. Where does the insanity of sueing people because of your OWN mistakes stop?

Are you going to sue your mortgage lender when you fall behind on the payments and they threaten forclosure on your property? Maybe you need to spill some hot coffee in your lap... Then you can sue SOMEONE because it was hot. Maybe even down to the guy who picked the beans. Maybe I should sue because someone accused me of working for a collection agency. With all the STUPID lawsuits, who do you think wins in the end? Lawyers and Insurance companies, NOT the consumer.

It's not time BIG business suffers, it is time to take PERSONAL RESPONSIBILITY for YOUR ACTIONS. Quit blaming others for the situation you have put yourself into.

If a collection agency crosses the line, they should be penalized, fined, whatever. The state should get the money to help regulate the industry better. The debtor shouldn't get a dime. They knew the terms of the loan. Had they either not taken it out, or upheld their obligations, collection agencies wouldn't exist. PERIOD.

I dont know who this "guest" person is, he/she is completely out of line. Consumers such as ourselves are falling victim to what is being called "predatory lending" by taking a short term loan with outrageous interests rates to get us out of a temporary finanical hardship. This short term loan then turns into hundreds if not thousands of dollars if we end up refinancing the loan before paying down or even paying it off. Granted, we chose to take the loan and agreed to the terms and conditions,and most of us have paid on them, however you have to remember some of us were desperate and in a financial bind, shouldnt have the loan company evaluted our ability to repay the loan based on their overall finanical situation and not just a paycheck before they agreed to give out the money? We have other finanical obligations you know, mortages, auto payments, utilities, electricity, but none of these are taken into consideration when a payday loan company gives a financially strapped consumer money. Therefore when the consumer starts to fall behind on paying their mortgage or car payments, you wonder why the consumer goes into default? Inability to pay is not a refusal to pay!

It is the abusive and dishonest practices such as Ellis Crosby & Associates as to why we are here. GUEST, in case you have not noticed, this forum is for consumers with valid complaints regarding illegal and abusive collection practices. This forum is designed to help and inform consumers. It is not here for your personal oppositions.

Yes indeed you obtained the loan, now is it their fault you fell into the troubles you did. Their job is to lend you money not question your integrity to pay it back on time...your an adult dealing w/finacial lendors. They will get the money one way or another... They could care less about your problems, You broke their contract..Better luck next time...

i have receieved yet again another phone call from a jay bernstein...message was left on my voice mail at work...i am waiting for some papers to fill out and send back to the florida atty's general office regarding the harrassment, the threats and whatever goes along with it....should i return their call or wait for them to call be again....do i inform that i am filing a suit for harrassment, etc...any info anyone can give will certainly be appreciated..loans have most likely been paid off by now...have already sent money but it keeps going up...

IPAYMYBILLS, I apologize if I gave you the impression that I believe it is the payday lenders fault that I defaulted. My point, no matter how idiodic you think it is, is the reason why consumer protection agencies are fighting to get tougher laws to regulate the payday lending industry.

As far as breaking a contract, I didnt even know that I had an outstanding balance until I got a nasty call from Ellis Crosby & Associates. The payday lender never once tried to contact me about an outstanding balance. As far as my bank statements showed, I was paid in full. I am still trying to get them to validate the amount they say I still owe.

Nevertheless, is it too hard for you to keep your personal remarks to yourself? We are all consumers here working with each other to try to find answers and help each other get back on track. Your personal remarks arent doing anyone any good here.

Does anyone know anything about A S and Associates? I received a call from them saying the same thing about having papers done on me, and faxing the information to my county, and it will show each time that they tried to collect on that one transaction, and that they will treat it as bad checks and have me arrested. Is this true?

Hello. I just recently got a call from Ellis Crosby and Associates and they told me that if I didnt pay them $740 by tomorrow that I would be facing criminal charges. When I got online to see who they really where, I never even found a website. All I found was that they are being sued by the Attorney General of Florida. I asked them to give me more time and they were really rude. What should I do?
