I just received a call from Ernest Priestly and he stated that I had to pay them by 3 PM today or I would be going to jail. They were going to send a download to our local authorities. The cop would be coming to my home and job a little after 3 pm today. They said I had two charges of theft by conversion and collateral check fruad. I only borrowed $200 and he said that I needed to send via Western Union $515.00. I am afraid that they will be coming to my job today and lock my up. Please give me advice. Should I contact an attorney.

I just received a phone call from someone by the name of mike weistein from ellis and crosby, he said that his company was hired by fsm and that as of 4pm today there will be a suit against me and it will be made public to prince william county where i live. He said to me that he is not trying to collect money from me but I am a habitual offender because i closed my checking account so I could not make the pymt. I informed him that i didnt not close my account my bank did when I had too may nsf's on my account, they said that they couldnt allow the charges to add up anymore.....I didnt commit a crime....he also stated that they have evidence against me and that my IP address was recorded for fraud. I must admit they have me kind of scared. Like I told him I really didnt understand that phone call if he was not trying to collect the debt, he stated that this was to make me aware of what was about to happen to me and I need to get an attorney ASAP, he also asked me it I ever had a record of writing fradulent checks before and I informed him that I didn't, before he disconnected the call he stated ......good luck to you is all I can say....and then he hung up.

PJD,

You can definitely contact an attorney to be in the safer side. But, I think they are trying to pull out money from you anyway. So you can offer them a lower amount that you can afford. It will help to keep the account current and save it from going to collection.

As per as the loan is concerned, I would suggest to pay it off and get out of the trap. Go through the payday loan related topics in this forum and see what people are saying about it.

Kenya- the only way they can lock you up for this is if you intended to commit fraud, that would mean getting the loan and closing your account and ran off and never contacted them agian, had no intention to pay back the money at all. Things like that.
Did you make any payment on it? Even one finance charge?

Yes atleast 3 or 4...but he is saying I intentionally closed the account and I did not, again my bank did, and fsm should have records...I mean I do from the old account.

I just received a phone call from Ryan Davis at Ellis-Crosby and he was telling me that my account was going into processing this afternoon and that the cops were going to come to where i work to arrest me and to take my company's computer hard drive. What do i need to do???

They said that to me too I regards to my companies computer....they have my IP address at my jod and that I used it fradulently. Lord knows I dont need that, I wish I could give u some advice but Im in the same boat. All I can do is hope nothing happens

Dont worry girlfriend, Your fine. They are not comming to take anything, In fact they are being sued by the Florida Attorney Generals office, you to can file a complaint with myfloridalegal.com and type in the search bar Ellis Crosby and Associates. Help stop these people so we can have a fair collection process!

They were threatening me about 90 days ago about a debt.
I paid them mony and i did not hear back for a while and now they are threatening me again.
What can I do?

Did you pay them in full Lynn? And do you have proof of your payment from them, or even a western union receipt? Do you still owe them money? I would contact a lawyer, and perhaps the original creditor if you can just to see where you are at. Write a cease and disist letter, also ask for proof of payment thus far before you enter into any further payments.You may want your lawyer to call to determine your actual debt still outstanding.Stand your ground and don't be bullied. If you are in a situation where they are disrupting work with the calls, talk to your boss first, then your coworkers and explain the situation. If you are honest, most people will understand and help you. And most importantly, pay your debt as quickly as is possible, just be sure it is the right person you are paying.

The have contacted me as well, just yesterday. If we don't have the funds to pay our debts how can we afford attorney's? I keep seeing responses that say get legal advise or contact an attorney, last I knew attorneys weren't free.

Most attorneys will give you free advice, or at least point you in the right direction. If you have an ACLU in your area, they might be able to help you.
