Joey,

This is a very common practice of Ellis Crosby. Don't worry at all. They are not allowed to collect money any more. Even the older assignments are taken back from them as they didn't pay the collected money to the original creditors in past.

Go through this forum. You'll find lots of discussion on Ellis Crosby. Just read those posts to acquire some more knowledge on them.

I was (until about 2 weeks ago) phone harrassed by a supposedly attorney from Ellis & Crosby. About 2 months ago, they told me I was going to be sued and would lose everything because of non payment of online/payday loans. Well, I wired $840.00 to them to help settle the debt. Lo & behold, they called again 2 days ago, and when I said I had paid the money, my called had totally forgotten about it. Thats when I became supicious. Yesterday I received a letter from a collections agency in New Jersey, representing the same payday loan company saying I owe the original amount. I will not pay anything to anyone until I have proof they are legit.

You have every right to be suspicious. Ted Ellis Crosby & Associates are
currently under investigation for unethical business practicing. They
obviously got you, by saying you'd go to jail if you didn't pay. You
will never go to jail over a debt unless you default on a court order
judgment...which usually you have to go to court over.

In your situation, I would file a complaint with the Florida Attorney
General, the FTC, and the BBB. You may be entitled to participate in the
lawsuit going against Crosby.

Find your receipt that you paid Crosby, and this will be sufficient
proof, for anyone else who gets the old account. Crosby has been tacking
on high fees (calling them court fees), and then reselling the account
to new collection agencies.

It's good that you're protecting yourself. Keep yourself armed and be
prepared for their next move.

Regards-
Mike

Show FSM the receipt of your payment made to Ellis. FSM will have everything proven after they will see your receipt. Also get your credit report updated. This account should be shown as 'paid'

Call FSM as soon as you can. fax them your receipts and they will assist you in clearing the debt. They are quite nice to deal with and in fact , in my experience, they helped me personally and contacted the CA to have me removed from their database. They also mailed paid in full to me. And if Ellis Crosby calls, know this FSM is owned by BMG- and they have ceased ties with EC.

They too have called me at work threatening to take me to jail and say they are attorneys and have filed a suit with my county clerks office. I used to work for a debt collection agency and I know that they were breaking the law with these tactics. I wrote them a letter telling them to stop calling me at work and that I would be more than willing to deal with the original creditor, NOT them. I also filed a complaint with the BBB and with the Attorney General of Florida. I have not heard from them since. FYI, here is what the BBB has to say about them http://www.jacksonville.bbb.org/comm...ompid=24000640

Todd-

Welcome to the forums. The information you need should be in this thread. But it is provided below. Make sure they actually own the account. If you've paid Ellis Crosby & Assocates, and FSM hasn't contacted you, then this may be one of the accounts they reported.

However, since you've had to deal with Ellis, you're still entitled to lodge a complaint if you received the same punishment and harassing phone calls.

There telephone number is
800-363-3630
There address is
FSM
PO Box 834
Mentor, OH 44060

Mike

I have tried calling FSM at the 800-363-3630 number and I can not reach them. I have tried callin the NJ collection company and I get put on hold forever and I have no choice but to hang up. FSM has NEVER contacted me regarding the debt even when it was valid. Ellis Crosby did all of the threats. Help!

Todd, as your debt is sold to the collection agency, the creditors won't be willing to work on it. You need to wait for some time till your debt is sold to another collection agency. Once it is done, they will call you up.

Bishop,

This is the technique ECA uses to get people scared. They will never come to your place nor will they sue you.

If you browse this forum, you will see numerous instances where the same thing happened with others.

Go through the link below to understand the right and legal process of debt collection-
http://www.debtconsolidationcare.com/fdcpa.html

I will suggest contacting your original creditor to repay the debt. Or you can wait until your account is passed to some other collection agency.
