I live in Bryan Texas adn I have been harrassed by Ellis Crosby and Associates at my job and at my home. I had a payday loan in January of 2005 for 400.00 and I got married in January adn closed my account then and reopened a new account with my husband, at that time I sent a money order to the payday loan company and paid off the loan in full. My mistake was holding onto the money order stub. I received a phone call on July 11th, 2005 from Ellis/Crosby at home stating that they were investigators and that they were going to the courthouse to file suit against me if I could not pay $1,400.00 in full by the end of the day. I got the info on where the loan was taken from and had let them know that I had paid it off, but they did not care and told me that I would be arrested at my place of business and that they were going to call my boss and let them know that I had been applying for loans on the internet at work and we would see how that went over. I tried to come to some negotiation with them due to the fact that I had lost the proof of payment and asked them why I had not received anything in the mail. Their reasoning was that "they did not have to contact me" and when i asked for the number to FSM (where i had obtained the loan from" they told me that it was beyond that point and they were prosecuting me. Please give me advice, I just accidently ran into this sight and am so grateful!!!! I took down the number to the Federal trade commission in which I intend on calling tonight. Can anyone direct me in to what to do next?

Well maybe i am, I am glad i found this site. I had a loan from FSM for 300 and ECA is claiming i owe 935. They didnt say it was ECA but i am assuming it is as they have ECA in the division # i am to put on the money gram and everything sounds the same as their call to me. They scared me and i told them i would pay tomorrow but it doesnt sound like i should. Should i go retain an attorney as i plan on filing BK and call them back with the #? Should i ignore them and try to work something out with FSM? Should i call and request papers? What should i do. My loan was in SC and i now live in TN, does that have any effect? Thanks for all the great info. Also, i am on probation for something UNrelated to anything financial, can this or any other payday loans have any effect on my probation?

No it wont relate unless you did commit fraud, But they are all telling us the same thing, "you commited fraud"
But we didnt! They are just saying that, unless you did intentionaly do it. I would send them a cease communication letter. Which you can find on BUDHIBBS.COM, They cannot arrest you either, Just tell them to simmer down. And Fsm wont allow you to pay them Ive already tryed to pay mine with them.

I just called and talked to someone there. He would not even give me the name of the company so i am still not positive it is Ellis Crosby and he also stated they do not accept incoming mail so he would not give me an address. When i asked the name of the company, he said Wyneberg (i am assuming that was his name and i asked again and he said Pre Litigation and that he was in charge of the warrants division.) He then said they will hand deliver a summons (not sure if he said summons, but he said hand deliver something. I cant remember as i was shaking mad at this point.) The # i was to call is 904-356-0927 and talk to Investigator Roebuck. I didnt commit fraud and i want to take care of this but not with someone like this. Is there any other way to take care of this? He also would not fax me anything and didnt want the name of my lawyer, he said to have them call him. What should i do next?

You should tell him to shove it! That is the number from Ellis and Crosby but the reason they wont give you their name phone number or address is because they have been suspended and revoked from any kind of collections, i think they will be shut down thats why they are acting so shady! I personaly am not paying someone like that at all!

I received a call from Ellis Crosby and Associates at 11:00 AM this morning stating they were going to file 2 counts of Fraud in Harris County if I did not pay by 2:00 PM. The told me I would have to obtain counsel to get me out of Jail!

At 2:00 PM they called my boss and asked him if he would be able to identify me when they came to pick me up at the office. My boss was very upset with me? They just jeoparized my job.

If anyone out there gets a phone call from anyone at Ellis, Crosby & Associates; please by all means don't let them intimidate you. Just tell them to file what ever paperwork that they are going to file and send you a copy. I bet that you will not get a copy of the paperwork because they have been suspended by the "ACS" for ninety days as of July 1, 2005. They can not collect funds from anyone for any reason. In the state of pennylvania, texas, north and south carolina they can't garnish wages for consumer personal debt. just things like federal student loans, taxes, child support. even if they say they are taking it to court.

I hope you don't ever get in a situation where you need help and have to go to a payday loan company or anyone at that matter. I think that you should find you somewhere else to post messages if there aren't going be positive. I am assuming these people took out payday loans so they could pay their bills.
