Default Freaking out

Hi there~
Ellis Crosby and Associates called me this morning and I was in tears! They are telling me I owe over $2000 and that this is a felony and my court papers would be filed against me today at 1pm and that I would have to go to court and face possible prison time...please tell me not to freak out about this, my mother and I have been reading all the comments you all have written and I am just so scared. I want to call them to ask them the payday companies called that I owed, but I am so scared. Please tell me what I need to do.

Kditimus, you and your mother do not need to worry about it because they are involving themselves in these kinds of fierce actions regularly. All you have to do is to file your complaint at the District Attorney office and the FTC.

Do not get stared if they call you again. They want that you start paying them fearfully. Inform them that you are aware of your consumer rights and their business membership has been suspended. If they want to correspond with you, then they need to validate the debt first before you enter into payment plan with them. But this is not at all necessary because the FTC will ensure that such kind of business do not operate in the market violating the fdcpa laws.

Be rest assured that you are in safe side and don't need to panic at all.

Default Ellis Crosby & Associates

I also was one of many to get caught up in payday loans i had 8 of them. I had to colse my bank account due to some bank problems. You can guess me and my son have the exact name and both bank at the same one.
Anyway i called all 8 of my loan companies told them what the problem was and offered to pay or do payments. They all said it was to late and they will go into collections. OK i guess. I resieved a call from some one at Crosby's tried to get his name but he got very upset because i had to ask him his name several times, oh this could take all day he said.
Then he told me that this was an attorney and they
were working with 2 of these loan co's He told me that
i owed them $1060 for loan totals that were only $400.
I am on social security disability and told him i could pay on the 3rd of Aug. Oh but that wasn't good enough for them. Then he told me that within 48 hrs they would have me arrested for fraud and writing bad checks but if i paid them $530 today they would stop this procedure. Told him not today. He said fine and good luck in court and hung up on me. I was so mad and scared that i was going to jail and my medical problem flared up. It took me 8 hrs and extra medicine
to get me feeling better. Far as i'm concerened they can go to !!!!!!!!!! I was really relieved when i found this site. What do i need to know about the laws
in Iowa. Dave

Dave-
Please go to your Iowa Bar Association website as they can tell you whats legal. And then you should report them through the ACA international website, and also the Attorney General of Florida. Let me know if you are interested in filing a lawsuit on them, i intend to find more people to go in with me on it though.

Katie, I would be interested in getting involved with your lawsuit. Olivia Valentine called me at work on 7/22 & told me she was sending the police to arrest me for felony fraud & consumer theft If I didnt give her $680 by 5pm friday. She had me really believing her because she was acting like she worked for the district attorney's office, she never said she worked for Ellis Crosby, she only said that the complaint was being filed by them. Afte the conversation I started to think something didnt seem right, in Texas the DA doesnt call you if they are going to arrest you & I remember reading somewhere that you cant be arrested or defaulting on a payday loan, so I did a search on Google & came across this. After reading this I decided that I wouldnt send them any money & I havent heard back from them yet.

BTW, today I filed a complaint with the FTC & the Texas Attorney Generals office. When Olivia Valentine called me she didnt say she worked for Ellis Crosby she acted like she was an agent for my county's District Attorney, I didnt realize she was actually employed by Ellis crosby until I read a few post's here that mentioned her name. I know it is illegal to pose as an officer so I let the Texas Attorney general know that she did this.

Default Ellis,Crosby & Associates

What a relief it was to find this site! My father received a call from someone from Ellis,Crosby & Associates and they told him I needed to contact them right away, so I did.....And this man knew my maiden name, my ex husbands name, my place of employment, my old addresses, and all sorts of other personal information about me. He told me I would be arrested at the end of the day for internet fraud. He instructed me to pay $897.00 on a $200 loan and if I wasn't going to pay I better get a good attorney. I was a total mess. I left work and called the first attorney that I could find to see me on short notice, and I told him the whole story and he laughed. He said to call them back and ask for proof that I owed this money and that if they needed to speak with me from now on they would have to do it through him. So I called them back and spoke with the man I had spoken with earlier and he said he needed proof that i had hired an attorney and I got his fax number and my attorney sent proof of representation and that is the last of I have heard of them. But that is the scariest feeling in the world to think you may be arrested and at the time you are talking to these people you have no idea who they are, and they are throwing all this information at you so fast....These people need too be put out of business.

I just received the same call from a Carie Marcinkoweicz and she threatened me that she was filing a fraud case against me today and that she was requesting the hard drive of my computer from corporate and that if I didn't come up with the money in two hours. She also threatened that I would loose my job. I called the attorneys office and I am waiting on a call back. If someone reads this please email me a response. I am totally shaken up right now.

Default Hello

Hello!

I was also victim to them once, but not twice, after I researched these peoples, and the place I owed the money too have yet to get there money. Not sure what in the world is going but I am hopping they get put out of business. I have filed a compliant with these people because they tried to call me about other payday loans I have. I urge EVERYONE to call the FTC. or just goto FTC.GOV and file a complaint. I would also file a complaint with the flordia bar assoctaion sense , they told me they were also law firm. I will be doing that and I am going to try to get info from the ftc through the fioa if possible on how many complaints have been filed and what I can legal to sew them. thank you and just remember they are full crap.

Default ellis crosby

I received a call today from this company and had some suspicions after talking with them. They threatened to file suit for fraud, all together I think there were 3 charges. The problem was they would not tell me the charges a second time. I also became suspicious when they stated they had tracked my IP address and gave me my e-mail address as proof of this, the IP address is completely different from your e-mail address and the e-mail address was provided on my application for the payday loan. They also increased the size of my loan by at least 2x. I was so shook up after the call I started calling about other loans, but realized I would only be digging my hole deeper. I decided to check on the internet to see what I could find out before making any further moves. I am soooo glad I found this sight. I will be contacting someone regarding taking care of this situation. I do need the address for ellis crosby so I can give it to my attorney. Thanks again.

Ellis and Crosby says they are lawyers ( when they are just a collection agency) and they have been threatning to pick me up within an hour, if i cant pay right away. ELLIS and Crosby thinks i am a HABITUAL offender because the loan comapnys are screwing me. But what they dont realize is that these loan companys are charging extra if you dont pay ontime. My orginal amount was $200, Ellis and Crosby racked it up to $560, just so they could file a suit aginst me. Its like they are doing it on purpose. GOOD THING I WORK FOR A LAWYER, and i have been informed.
THERE IS NO DEBT COLLECTION PRISON!
Ellis and Crosby has threatned to make me loose my job, and talk to my boss about it. In texas they cannot garnish wages without a court order. And they have totally violated a law.

Dear Guest-
I would tell them to stick it, and hang up. Because they are so stupid. What is the #1 rule regaurding getting money from someone, BE NICE TO THEM. I mean who wants to give someone who is threating them money? It just dosnt make any sense. I dont know who they think they are anway. No one in my book. If they call me agian ill be sure to tell them to you know what!
