|
|
In December of 2004 I got a call from my parents screaming at me that I owed Capital One $1,900. At first I was very confused as to how they knew that as they live in NH and I was living in AZ, which is where all of my bills were coming. They then told me that they spoke to some woman on the phone who told them that I owed this amount of money and would ruin their credit if they didn't pay it. Long story short--the woman disclosed my personal information (credit card company, amount owed etc) to my parents that I hadn't been living with for over 3 years...is this legal? I always thought it was okay for them to ask for my phone number/address but not give out such details...please help

Welcome to the Forum..
I believe this is correct, it is not legal to divulge information to another person except the debtor and/or their legal reprsentitive/Guardian/POA.
On the other hand, are you sure your mother/father did not "mislead" the CA rep as to who they were talking to?
And..if your Mother/Father are not co-signers or any such thing why would/should they be worried about your credit transactions affecting theirs?

As Jerry said why are your credit transactions affecting your parent's credit? It looks like they are co-signers to your account.
They are not supposed to disclose your personal information to anyone except the related parties in transaction.
Welcome to the forums.

You are correct, they are not legally allowed to disclose such information to third parties, and you can sue them for fdcpa violations, would recommend contacting attorney, and filing complaint with the FTC on this matter.
