I received a harassing phone call from Ellis Crosby yesterday and my work. They said a lot of things and threatened me with going to jail...the bottome line is that I had to pay $560 before 6 pm or they would have me arrested and my hard drive from my office subpeonaed. Not knowing anything about them I did monegram them the money. My question...since they are under suspension...what happened to my money? Is the payday company considered paid in full?

Ellis and Crosby has been found to be widely violating the FDCPA laws in recent time.
They have also been asked to suspend their activities for 90 days by ACA.

Please go through the following post to get more information.

So, Ellis and Crosby cant call you up and threaten you about taking you to jail.This is total violation of FDCPA laws. Also they cant dictate you the time of payment without proper orders from the court.

Before sending the money it would have been better if you consulted an attorney about this matter. However I can understand that you must have become very worried with the things they said.
Do you have any documents which can prove that you had made the payment to Ellis and Crosby? Have they provided you with any receipt in acknowledgement of the money you sent through monogram?
Speak to a qualified attorney regarding this.

I have already mentioned that you need to have proper documents to prove that the debt is paid off. Without proper proof of payment it may be difficult to prove that you have paid Ellis and Crosby $560.So please get in touch with Ellis and Crosby and try to find out if your payment has been received properly and also demand receipt of your payment from them in written form.

I do have the moneygram receipt that says I paid it to Ellis Crosby and Associates. It laso has on the reference the payday company that it was supposed to go to. I did talk with Ellis Crosby and they said I would receive a letter in 7-14 days saying my account was paid in full. Do I have any other recourse at this point on getting back any of the money over my laon I paid?

I sent them Ellis Crosby and ASSociates 200 of the 600 they told me i needed to send them through money gram, but after i got myself together enough to realize what they have been doing i went back and found out they did not pick the money up, Check to see if the money was sent through, if not you can do what i did and cancel it and have your money either sent back to your account or redirect to you. That way you have your money atleast till this mess is cleared up.
let me tell you Paul Epstien for this Ellis Crosby and ASS ociates, was very mad that i told him i was only sending 200 not 600 and that he would take it or leave it, then i know that after days (3) went by and the money was still at the money gram place that i needed the money more than they did obviously, so i took my money back. I have not heard from them in 2 months.
Probably will now that i am talking about them, hehehe
but that is ok, I AM SO READY NOW Twisted Evil

Rich - Have you realized one thing that people from Ellis Crosby contact the consumers once only? After the consumer notifies them of their illegal action, they stop calling them further.

I guess from where they are getting information about the innocent consumers. Surprised

ben- Yes I notice from my experience and the experiences of other here on these forums that the effectiveness of their collection habits normally only take one call. They brought me to my knees begging god for help, when i got the infamous call, the ring heard around the world, so it seems. It is solely my intentions to take this matter as far as i can possibly take it. Im thoroughly pissed that my rights were violated in this manner. I already felt guilt for my inability to repay my loans, which probably justified the mental and emotional state of mind i was in once i got the call. I can not beat myself up like that, it is simply not healthy for me.
I WILL GO TO ANY LENGTHS TO BRING THIS VIOLATION TO JUSTICE AND TO HELP OTHERS THAT FALL VICTIM TO THIS COMPANY. WE DONT HAVE TO WALK THROUGH THIS ALONE!

I just got a call in the middle of work from Ellis Crosby and Assoc.
It sounded fishy from the beginning.
I knew ahead of time that I owed payday loans to two companies: E-DollarsDirect and Alpha Processing. I hadn't yet been able to pay them but had every intention to this coming week.
Keep in mind, neither one of those two payday companies above contacted me at all regarding my outstanding loans.

The Ellis rep called me and told me I was being charged with intent to maliciously defraud those two companies with US currency. What???? Then when she gave me the two totals I owe, which were MUCH higher than I borrowed, she told me that there was a TWENTY FIVE dollar late fee EACH week after I had taken out a loan. I DO NOT remember reading that in anything I signed.

As it stands, she said I have until 2pm to send those two totals, which I DO NOT have. She said it then goes to court, my county will be notified and I will owe $1800.

IS this legit? I do not know. If I get a federal court-ordered summon from my county, I will pay something, in order to avoid court...but this is nuts.

It is not legit and they cannot demand you to pay anything only a court can do that in which you will be notified of any court apperances by mail, or corrier. Do not be intimadated by them at all

guitar_slayer - As Katie said, do not get intimidated at all. They are trying every forceful and illegal method so that innocent people like you start paying them hurriedly over anything.

Their is a legal way to everything and everybody knows that Ellis Crosby has violated it completely. If you start paying them due to their threatening, they will sound stronger and will look out for another prey.

Discuss it with us if you face any problem by them. We will make you feel stronger. Smile

I am SO glad I found out all this information before 2:00 when my deadline was for payment via Western Union. I also only borrowed $300.00 from E Dollars Direct and Investigator Karen Baker tells me I owe an additional $395.00. I don't think so and to think I almost sent it!! If anyone needs another voice to be heard, I am HERE for you and will do whatever it takes to be sure this company doesn't intimidate others as they seem to continue to do to make money that does not belong to them. Anyone else out there I hope will join together and not let them get away with this scam. If someone will please let everyone know exactly what measures we need to all take to stop them...PLEASE let us know ASAP!!

you stated you are willing to help, here's what i ask:
call Summer Saladino @904-348-2720, she is in Economic Crimes Dept. of the Attorney General's office in Florida. Ask her How you can file a complaint on this company. And Please follow through.

I appreciate your support and info!

Yesterday, after I received my harassing call, the woman who called me took it upon herself to call one of my co-workers around 2pm (I had left work already). Apparently the woman "investigator" went beserk on my co-worker and demanded that my co-worker give her my HOME phone number. Luckily, I work with the gvnt and handing out info like that is not allowed.
My co-worker called my home all upset saying that the "investigator" was demanding to get a hold of me, that she was going nuts on the phone, and that she said she's going to call my boss.
I had to reassure my co-workers, embarassingly, that the woman is NOT an "investigator" and that I'm not going to get "arrested."
My co-worker informed the "investigator" that calling my work and harassing people is illegal and that she'd best not do it again....to which the "investigator" replied, "We ARE a government agency, too."

Uh, no you're not. So....today I am going to contact ACA, FTC and Florida about this.

My question, however is...if we DO have outstanding loans, what should we do about paying them? I have 6 loans out and need to pay them all off.
I just got done getting in a HUGE fight with Sonic Payday loans...where one of the "loan officers" said he was going to send me to court, and etc...This guy called my work incessantly and harassed me nonstop and was rude. I had to change my phone number and address (got a PO box).
I'm considering a debt consolidation right now, since I'm slowly falling in the red. At 19 years old, I would have never imagined I'd be going thru stuff like this! Rolling Eyes

Well they don't know when to quit!

I just got ANOTHER call from "investigator" Sanchez.
She asked me to send money TODAY. She tried asking for my home number, but I wouldn't give it to her.
I briefly thought of giving her the Florida State's Attorny number or Summer's number, as my "home" number but I dont want to get myself in trouble.

She said she's going to send me an "exoneration" letter. Has anyone else been told this or know what it is??

Gutiar-
I am in the same boat but i have 13 loans! And im only 21. I think this whole thing we are all having to go through is CRAZY! I think they should stop possing. I have talked with Summer and she has told me that anyone else we can get that is having problems, please contact her. Ellis and Crosby deserves to be shut down, they do not work for the goverment, otherwise the goverment wouldnt be trying to do invesgations on them Smile
