Hi, I was being harrassed by a collection agency over a debt that is a few years old. I wrote them and asked for validation and never heard back from them, this was several months ago. NOWI am hearing from an altogether different agency. Got the letters in today mail. Why didn't the other agency just send the validation when I asked for it? could this mean that there might not be any? This new agency is called encore ---if anyone knows anything about these people, please share. SO...do I respond right now with a validation letter to them? just curious as to why the other agency didn't send validation if it was available? thanks, shirley

Hi Shirley,
Welcome to debt consolidation forums.
It is quite strange as to why the previous collection agency did not respond to your validation request .You can resend your request to see if there is any response from them.
One reason why you are hearing from a different collection agency is that the earlier agency has sold your account to another agency. Before going into any sort of payment plan you should first ask for debt validation.
To get rid of these sort of harassments you can enroll in a debt consolidation program where by the companies handle these collection agencies, save you from further harassment and also negotiate to reduce your debts.
You had mentioned that the name of the collection agency is Encore.

just speculating here, but could it be that maybe they couldn't produce any evidence (validation) so they decided to pass it on? I am definately asking for validation from this agency as well...am curious as to what happens next. (whether they will produce it or not) thanks, shirley

I am totally new in this thing. My husband's starting his business and he's having problem with one of the collection agencies as well. The one with name American Agency.
What is a validation letter? What is it good for?

Welcome to the forums. Please do not feel shaken while dealing with your collection agency as the whole community is with you to guide in the right direction.
The collection agency is assigned to recover the debt from the consumers when the creditors fail in their actions.
In order to make sure that the collection agency is actually working for the creditors, they have to provide some necessary details about your accounts. As per the FDCPA law, debt validation letter is a strong weapon through which you can legally urge the collectors to provide a proper presentation of your accounts.

If the collectors are not able to furnish the necessary details about your accounts, it will be considered that they are maliciously forcing you to pay towards your debt. You are required to obtain the following information from the collection agency before you start paying towards your debt account.
- The details of the account.
- All the calculation should be shown of the amount that is owed.
- Any copies of the papers to be furnished that shows the payment agreement.
- Provide a verification or copy of any judgment if applicable
- The original creditor needs to be identified.
- The Statute of Limitation needs to be proven for the collection of the debt.
- The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent
- Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.
- Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.
- A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

The only comment I want to make is never go through a debt consolidation place. They screw your credit up even worse than if you don't pay the bill. It takes two too three times longer to get your credit straight after going through a consolidation place, I know I am still suffering from going through one. They are not what they say they are and they rob you blind!!!!!!

Encore is a horrible bunch, they are used to breaking federal law so it is important that you educate yourself on the law and your rights as much as you can.
First, what happened is legal--the law allows them to sell the debt to another CA instead of validating it. What you need to do is send that same DV letter to Encore. Be sure to send it certified mail so you will have a receipt of when they received it. Encore likes to tell consumers that "we didnt get any letter from you", so send it certified to cover your butt.
Usually when this happens, it is because you asked for validation and they cannot provide it. So, the law states that if they cannot or do not provide validation they must not try to collect the debt from you ever again. That is specific to that CA, though. So, if you send one to Encore, they must immediately stop all collection activity, gather the validation documentation, and send it to you before they can start up trying to collect on this debt again. Or, they can sell it off, which is what many of them do once they realize they dont have the documentation the law requires.
Send off the DV request, and let us know what you get back if anything.

Can you still ask for a DV if you have already made a payment to them? And also, what happens to the debt if the credit card company has sold it to a CA, and the CA cannot collect because of not having the DV? Does that make sense?

As far as I know [somebody will correct me if I'm wrong], you can ask for validation at any time. They may or may not be required to produce it, but I personally wouldn't pay them another dime until they did.
As to the card co. selling the debt to a CA who can't validate, that's their problem. You still owe the debt, but you can't be forced to pay a CA without validation. Else, how do you even know you're paying the right people?

Would like to ask some advice on NCO. I've seen a few threads on here, in the past, however....I din't really read them. NCO..are they a LEGIT company? They have called me several times, but, I don't know WHAT they are calling about. They call here, and ask for me. THEN they say they want to "verify my debt," and need more information from ME. If THEY are the ones who have an outstanding debt from me, shouldn't THEY be the ones to tell me? It keeps going 'round and round'. Any advice?
