I just received a phone call from an investigator form Ellis Crosby and Associates that said I had two payday loans outstanding with them and that I had charges being filed against me at 12:00 today. I told them I knew what she was saying but that I also knew that they were under suspension. She informed me that they were not under suspension because if they were then she wouldn't be able to contact me. She said I had to call back by 12 today with an arrangement or they were filing charges against me. She said the balance on one with the out of court restitution was $800 and the other was $560. These two loans total only equaled $500. So what do I do? I paid them $560 3 days ago for a loan I had. The original amount of that loan was $260. Do I call them back or what do I do at this point. They said I could have my attorney contact them but they would give my attorney the same information. Please someone let me know the best way to handle this? Are they really under suspension??? Thank you

Hi mdow315,

Welcome to the forums.

The information that Ellis crosby has been suspended is correct. ACA has suspended their activities for 90 days.
So if they are carrying on their activities its illegal.
They have been suspended from June 1,2005 onwards.

So you don't need to worry. But don't make any payments to them under any condition because your payments may not be reflected on your account.

If they continue to harass you then you can file a complaint with FTC.
Also take advice from your lawyer about your next step.

Thanks thirdeye. When they called my Friday she told me htey were not under suspension or it would be illegal for her to call me. I did file a complaint with the FTC and with the Attorney General of Florida. If I'm not to make payments to tehm should I contact the original creditor to arrange a payment with them?

ACA International is an international trade organization that keeps information about the credit and collection professionals having offices in California.

It is a government organization that is designed to educate the consumers, business professionals and various other agencies about the laws prevalent in the credit and collection industry.

If any agency is practicing unfair business, the ACA has the right to suspend the business. Ellis Crosby had been practicing unfair collection efforts and as a result their membership has been suspended by the ACA International.

You mentioned in your last post that you contacted Summer Saladino who is also working to stop unfair collection practices. So, it does work Very Happy

Calling endlessly to the consumers is itself a violation of the FDCPA law and these acts also need to be reported to the concerned government agencies.

We should encourage our community members to lodge complaints at Summer Saladino as you have mentioned in your last post and we are definitely going to see some quick action.

Roxette- I am so excited for something finally to happen to them! Hopefully it is in our favor. I got a letter from the BBB telling me they had no response from Ellis and Crosby and that was it! They couldnt do anything else... Surprised

I received "5" calls yesterday (08/08/05) from a Crystal Freeman of Ellis Crosby & Associates. Two at work and two at home. Each time, she left a voicemail. I called her back this morning and left a voicemail telling her I knew they were suspended from collection activity by the ACA Ethics Committee until September and I asked her to cease all phone communication and that I would only deal with them by mail. I am waiting to see whether or not I get a call or two, today.

I received a phone call this morning at work from Ellis Crosby and Associates. The individual I spoke with said that I had until the close of business to pay or I was going to have fraud charges filed against me and arrested. Can they do this? I filed a complaint with the FTC and contacted the Attorney General in Florida. Please someone help me understand if Ellis Crosby and Associates are capable of doing this?

I paid them $250 of th $1025 they said I owed and then I found your site. I then faxed a discription of my experience to Summer Saladino with the FL Attorney Generals office. She sent me an affidavit to file a complaint with their office. I called Ellis, Crosby, & Associates back and told them that I knew ACA supended their license for 90 days and that I had contacted the FL Attorney Generals Office and filed a complaint. I haven't heard back from them since. So I believe it works!!!!

You can also make your move by filing your complaints at the FTC, BBB, DA's office and request for immediate legal action. It seems that it is in the process of some legal action very soon.

Thank you for the information and feedback. I will hold off on making any payments to them. I contacted the local magistrate office and sherriff department yesterday and asked them if Ellis Crosby and Associates could do such a thing and they said no. Thanks again for the information. I filed a complaint with the FTC and with Ms. Saladino (Florida Attorney General).
