hi,
Ive been living in the UK for 5 years now. recently ive been contacted by some debt collectors, "national payment center". they say they are trying to collect a student loan from 10 years ago. they call me twice a week, and send me 2 letters a week. I have asked them on the phone several times to let me see the original paperwork, but nothing is sent. They say they are taking me to court, etc even without my presence.
one lady threatened to garnish my wages, take my assets, etc. then another lady told me nothing would happen to me if I didnt pay it, as I live in another country.
#what are my rights here? I thought they had to provide this information, prove I owed the money? I need help! I dont have any money! I am unemployed, and keep telling them that. My husbands a student. The debt is for $1700.
I hope you can help. PS should I sent them that great letter?

First of all they cant garnish your wages without a court order. I would try and see if you could settle with them. $1700 is not a lot of money to ruin your credit for. Also, they cant threaten you in the process of their collection duties. I would send them a cease and desist letter as well.

Hi abgie
Welcome to the forums. As per the FDCPA laws, the debt collectors in USA cannot do anything outside the country.
However, there are some agencies that have a wide network in other countries and gather information from the banks.
Are you planning to return to USA? If not, then you don't have to worry much about it. However, if you return, there might be a judgment against you.
As a responsible citizen, I will suggest you to make payment arrangements regarding your debt instead of inviting tensions on both sides of the border.
Regards
Roxette
