It is a scare tactic BUT you have to take steps to prevent the wage assignment. Send a certified letter revoking the wage assignment and talk to your payroll department. The wage assignment is not court ordered and therefore they do not have to comply. If revoked, they are not allowed to honor it. Now if Sonic goes as far as to have a court ordered garnishment, that is an entirely different ballgame. You will receive notice from courts if it goes to this and garnishment is limited to a certain amount - not your whole loan amount as indicated in the wage assignment. Please understand I am not saying that Sonic cannot collect what is owed them - only that the "wage assignment" they threaten with is not legal. Yes a payroll department may honor it IF you don't revoke it and IF you don't talk to them about it. They will consider it a "voluntary" wage assignment that you agreed to. The agreement we all signed says it is irrevocable but that is not true. The FTC banned irrevocable wage assignments in 1985.

Thanks to everyone that provided very useful information. I sent a "cease and desist" letter by fax to the corporate office (by caliing the corporate number given by Mr Big, stated that I needed to fax over inportant information regarding my acocunt, and was given the number no problem) And a letter for them to only contact me by us mail at my home or risk litigation from my attorney (which i have from my bankruptcy months ago) So far, no more calls. My bank has put a stop on all transactions from them and if i need to change bank accounts (which i may do) they will refund all of the nsf charges. Sonic has gotten more than their share of money from me. Their loan repayments are always split up into two parts. One half of my loan was paid, and the other half wasn't, but they still tried to put both payments through because according to them "I didn't pay it all back at once" So with the interest charges and nsf fees, I've paid the loan back and then some, so They will get no more money from me. And at my job, I was promoted to accounts payable head accountant, so all letters will come to me first anyway. YAY! Thanks to the guy that provided the wage assignment information, it was really helpful. Thanks again to everyone that responded to this thread. Hopefully at least the ones that are having problems in this forum will be rid of Sonic for good. :lol:

Hey guys, I too am into Sonic for over 700.00. However, they cannot garnish your wages unless they take you to court and get a judge to sign an order. The wage assignment is a scare tactic also. My company does not do any wage assignments. But if it goes as far as a garnishment signed by a judge, then they will, and that is only 25% of your wages. Don't let them scare you into signing and agreeing to a wage assignment.

UN-voluntary wage assignments were done away with in 1985 anyway. Plus, all you have to do is send a certified cease and desist letter along with a revocable (term?) wage assignment letter. This will let them know that you are taking back the volunantary wage assignment, and let them know that you are not willing to deal with them anymore. It'll go on your credit report if you don't pay though. I have had so many problems with them, that I just gave up. Getting through to the corporate office, and trying to find an actual address. Everything I have been told keeps getting me turned around in the wrong direction. I told the last supervisor that I spoke, while documenting the call (recording it) that they will get their money soon as I get an address of the corporate office, or to the president. (She kept giving me that College Green address is Ireland, but I've sent 2 things there certified...and they keep getting returned.)

I got suckered into Sonic Payday to. I had the money to repay them and called and spoke with Tiffany Stone to get all the info I needed, and was not supposed to be due for a couple of days and she told me that it was too late. She was not real nice about it and told me that I had waited to long and that it was being sent to my payroll company. She basically said Your Screwed and Have a Nice Day. My payroll company got a letter and told Sonic Payday that they would not and could not do anything without a cout order. We thought that that was the last we would hear from them. And it was the last time that we would hear a word!!! They then decided to go into my bank account and take the money out. They were only able to take out $372 and also tried to take out another $261. My original total repayment is only $500. So they are trying to take out an extra $133 which some how I am not let happening. We are so much in the negative balance in our checking account because of this company. Now I have to figure out how to pay back the returned checks that it caused me to have. Does anyone know how I can just tell my bank that I do not want anyone from these companies withdrawing more money without closing my account. Thanks

Janettech - You can ask your bank to do a stop payment without closing your account. They will charge you some fee but it will stop the unnecessary withdrawals.

i have about 5 200 payday loans from different company starting this friday they r going to take out a 50 renew fee but i will be broke i known i shouldn'n done that but i close my acct, and i known they will be calling my job so what can i do or say to get to stop i known i won't be able to pay at all

i apply for about 5 payday loans on the computer and gave out my acct and router number bad mistake but anyway the company started to put money in my acct now i can't any of them so i close my acct, i din't sign anything i know they r going start calling my job what can i say or do to get them to stop can i go to jail if i don/t repay

ACH's can have a stop payment to it. But since it's like an electronic debit, and not a check by phone...you will have to do (2 with sonic) a stop pay every payday. You're better off changing account numbers. Why bother closing your account all together? Now...Sonic cannot garnish your wages. The courts can only garnish your wages, and Sonic avoids court. They can do a wage assignment which you signed online. They've done away with forceable wage assignments which I heard from one of the mods in 1985. You can fax a letter over saying you are revoking the wage assignment. (Also tell your employer.) You can also fax them a cease and desist letter. If you do a google search you can find samples online.

Welcome to the forums. As you have a debt in your name, so it is better to pay it back. Not giving attention to it will hurt your credit ratings only and will create a bad impact on your financial worthiness.

Try for some consolidation program as it offers some benefits and makes the repayment process easier.

I dealt with Sonic. Last I heard from them (Mr. BAINS), they said they were going to come and arrest me (sound familiar?). Hate them!

Ah, and everytime I asked for their address, they gave me a new one everytime...
