Default Superior Asset Management

In an effort to work with SAM I had set-up payment arrangements for a $50 withdrawl from my checking acct. This was considered to be a "hardship" agreement. After six months they asked to settle the debt or increase the withdrawls to $86. While discussing the settlement (debt remaining was $1195 settlement offered was for $600)I stated I would have to check with my wife. In the interim my checking account was debited $600 w/o my authorization.

After checking with my bank they stated it would have to be handled my me in a civil action. I have a hard time accepting the fact that this company (SAM) is able/allowed to make unauthorized withdrawls. Do I have any recourse to recover my money quickly?

They aren't allowed to make unauthorized withdrawals, They most likely made the $600 withdraw under auspice that you had previously given permission for them to process ACH transactions.

To protect your self, whether dealing with SAM
(a personal vendetta of mine by the way) or any collection agency NEVER give give them a check by phone credit card by phone or any authorization to do regular ACH withdrawals. In order to do this you have given them all the information they need to go in and take money out of your account at anytime. Also, never do Western Union or Money gram, they charge excessive fees (up to $15.00) and your payment won't be paid any faster. Always insist on payment only by Money order, Cashiers Check, or certified checks only (even your own paper check they can get the necessary information to take withdrawals).It would also be highly recommended to send these payments CMRRR or PMDC (priority Mail w/ certificate of mailing and delivery confirmation, they can not refuse to accept mail sent in this manner like they can CMRRR).

Using Money Order, Cashiers or Certified check may cost you some extra also (not more then $5.00 depending on which you choose to use, but can be as little at $.50 )you are provided with a receipt, and can check with the issuer to see that the instrument was cashed.

It is very simple. They Must accept any payment you send them, and they must post it to your account (this does not meant they agree to any payment arrangements however). Even if they do not agree to your proposed payment plan, send them the money (assuming you acknowledge the debt or it has been validated). By doing so you are showing you are making a reasonable effort to address the situation within your means. Should they press the issue and take it to court, you will have evidence to show the court you ave been trying to work something out, but they are refusing to cooperate.

By the way A FOIA request with the Federal Trade Commission last years for records from 2004-2005 revealed 750 consumer complaints against SAM for violations of the fdcpa ranging from Harassment, discussing account with third parties, providing false or misleading information, threats of arrest and threats of physical violence or personal injury. These are not sane scrupulous people and should never be trusted with any confidential information.

FOIA request can be made in witting to any governmental agency. FTC FOIA request are free for the first 100 pages, and cost $0.10/per page after that. Unless otherwise requested, information is sent on CD Rom.

Yep my experience with Superior Asset Management who is apparently now the collector for T-mobile appears not to be on the up and up. I recently called them at 1-800-895-2989 and they would not even give me their mailing address. We had been dealing with AmSher prior to SAM taking over t-mobile collection and had already disputed t-mobiles claim through AmSher. Now this new company refuses to accept any decisions made under AmSher. What gives? Citizens ought to be protected from such shady collectors!

Default don't know what to do

I am trying to contact superior asset managment regarding the amount they put in my credit and everytime i try to calling it is just and automatic operator telling me my account with them has been cancelled and couldn't reach these ppl. don't know what to do and I am having a hard time trying to proof to the credit bureu that this amount should not be in my credit. help please!!!!!!!!! the # i called is 800-385-5512

If you loosers paid your bill you wouldn't have to post messages on this board. I work for SAM, it is a reputable and law abiding company. The company does not allow it's collectors to break the law and it teaches them the fdcpa and the correct way to deal with dead beats.

Default Debt collectors

I just dealt with Superior Asset Management about a T-Mobile bill. I found the staff helpful and very knowledgable. I owed the bill and I hid from it for 2 years. This company found me and I guess it was time to pay it. They were curteous and actually gave me a settlement. I want to thank the collector whose name was Tiffany for helping me.

Default SAM is harrassing me

Supriour asset managment countinues to call me looking for someone I have never heard of. I have called them and demanded that they stop calling only to have them start calling the cell phone I was calling from. They call every morning at 7:12am Im frustrated can anyone help?

Just Saying that i just got off the phone with my lawyers /c sam doesnt want to handle my case in a timely matter. The Manager Michael said that he was going to sit on my case and dont expect my maney back... sure!!! when its my money i dont play around... there's gonna be a couple of people getting fired out of that damn place!!!

No SAM is not ethical, or law abiding, the public records of the FTC speak for them selves. No one I ever tried to talk to at SAM was ever courteous or professional, choosing to SCREAM and YELL at me from the MOMENT I answered the phone. At least I was one of the lucky one that SAM's employees Didn't threaten with bodily injury.

SAM's reputation is for being a bottom dwelling collection agency with unprofessional collectors, and little regard for the laws under which they are supposed to operate. If SAM is so reputable and law abiding, why does their phone number and address change almost monthly? Why is the Florida AG investigating SAM for violations of the FDCPA and the FCRA?

IF your Client, T-Mobile, hadn't breached their own contract and not made false and misleading statements about their services,fees and coverage or actually had chosen to deal with the issues their customers called them with, then I would have paid them. Furthermore calling to ask them when my contract expires SO I COULD SWITCH TO ANOTHER CARRIER does NOT constitute a renewal as they tried to claim, then they hit me with a $200 ETF three days later.

Truth be known T_MOBILE owes me far more then I owe them in improperly billed overage charges.

You can locate Superior Asset Management at PO Box 47248, Oak Park, MI 48237. They are trying to rip me off for a debt that i never created. I understand from others that they are a crooked company, trying to force people to pay on fraudlant debts.
