Default Do not owe these people

This so called company has called us several times.
They are looking for someone named Scott Ziegler who evidently owes them money.
We do not know him.
We have had this number for over 5 years now.
It is in the phone book in our name.
How can I stop them from calling here and disturbing us.
We are older with medical problems and are tired of answering the phone to argue with them or get a message on the machine. Today, the guy hung up on me after I told him to please delete my number. I called back. A lady said she would take my number out of the database. This same thing was told to me the last 3 or 4 calls. I would change the number, but the phone company said I would probably get another dead beat's number. That they try to kill them for a year before giving them out. So, this company has been after him a long time. I just want them to stop!

Sending the company a cease and desist letter should do it. You may also have a claim against them, you can get an opinion from an attorney, maybe try looking for one on naca.net.

Default MAJOR HELP NEEDED RE:Superior Assets Management

I don't know where to begin. I am SOO frustrated. I am just starting down the road of trying to take charge of my credit and am finding roadblock after roadblock. The latest ended in a screaming match with the Superior Assets Management company representative. She not only refused my request for paperwork regarding my account and ended up hanging up on me. My "bill" was sold to SAM in February 2007 by the original creditor. SAM stated that they sent me two notifications - one that stated that they now had control of the account and another that stated they were not being paid. I never received these notifications - I doubt they were sent. They stated an incorrect address when I asked where the notifications were sent to. Anyway, they won't re-send me anything at all. NADA. I have been begging them to send me something, anything at all, stating what I owe them and how they came up with the figure. They refuse stating "Either pay it or ruin my credit further". I told them that they are not getting any money from me until they send something to me. They refused. Here's another step in this complicated process...I have a debt consolidator that just sent them $26 towards my bill with them TODAY. So, they are actually getting payments from me, via the debt consolidator issuing payments on my behalf. Is there any recourse to get information out of SAM or am I stuck? I am 21 and want to fix my credit NOW. PLEASE, PLEASE, PLEASE HELP!!! Is the letter that Roxette gave to the other requestor applicable to get information from SAM? Thank you so much for any words of wisdom.

First things first! Don't let these bottom feeders get to you. They know they are in the wrong, but will hound you and try to harass you in attempt to scare you into paying.

Under the law, you have 30 Days from receipt of Written notification either ask them IN WRITING to validate the debt, or make a payment if you know the debt to be valid if you fail to respond in any manner. After that thirty days they will assume the debt is valid. You can still ask for validation. BY law within 5 days of the first contact you should have received a written dunning notice from SAM (however I am certain you didn't). That's your first FCRA violation ($1000 should you try to pursue that).

If they fail to produce validation of the debt , they can no longer collect on it (however they will refuse and continue to try to collect) after about 4 months they will send your account off either to another agency or an attorney. Their attorney's (Arthur Corrales, Ft. Walton Beach, FL or William D. Smith, Atlanta (suburb), GA) also will refuse to produce validation, however they will comply with the fdcpa.

In the case of Mr. Corrales, I asked for validation, he did not respond and two months later I got a call from Mr. Smiths office. (at the time he contacted me he was not registered with either the Georgia or Illinois Bar Associations. He is Now registered with the Georgia State Bar after I called him out on this). He will attempt to validate, though his documentation was incomplete. HE WILL ATTEMPT TO DOCUMNET YOU MAKING COMMITMENT YOU DID NOT. You must correct this in Writing as soon as you become aware.

In my case I asked for validation and 6 months later I received incomplete documentation, however in an effort to resolve the matter I offered a payment plan which he has not yet to respond to (9 months later). Hope this helps some what . fee free to PM me if you have any questions.

Default SAM scam?

I just got a letter from them as well, for an account I know I closed out over 6 years ago. I don't know where to get the proof of this. But regardless I asked the SAM representative if they could provide the source or the dept or the documentation and they said they didn't have that. This reeks and is very fishy. I just read through the 10 pages of comments here and notice MANY other people are having the same situation. Where is our government when you need them to regulate out of control businesses like Superior Asset Management????

Am I getting the run around form SAM? I called they said they don't have the bill they are collecting on, that I should call T-Mobile. I called T-Mobile they said they don't have the bill, the agency does. I call SAM back and they then said that they can tell me but can't mail it to me, I mentioned the fdcpa requires they prove it, and they then yelled at me saying that "they know the law, not me". Then they hung up. I called back and then they said that since the debts have been through so many agencies that neither they nor T-Mobile has the bill to validate. I mentioned the FDCPA and they said that it only applies to the initial debt collection agency not them.

Is this for real? I seems so half-assed and unprofessional. Am I getting scammed and run around? Is T-Mobil in cahoots with them?

People, you are all doing the right thing by being cautious. If no one can provide proper evidence of debt, then there is no debt. I would ignore them and if they continue to harass you, call the police and file a report and/or contact a lawyer.

Default Address for SAM

I only have an the 800-587-5714 phone number and no address. SAM keeps calling my cell number, looking for another party. I have made numerous requests to stop these calls - with no success. The last time they called, when I asked for an address - they hung up on me! If anyone can provide a mailing address, MANY THANKS!!!

The person that I spoke to was not really rude, just not to accommodating. Said they were working for the Office of Jamie Roberts, which is a consultant for Bay Area Credit. They will only accept payment over the phone or via moneygram. When i asked for an address, they suggested that I google Bay Area Credit. They were apparently collecting for First Premier Visa at an amount twice of what I originally owed. When I asked for validation, I was told that they were unable to comply because I lacked credibility with the original creditor. I almost laughed in his face --- what a joke.

Please help. SAM keeps calling my house leaving a recorded message to call them. I did it was for mynephew. I told them he doesn't live here anymore. When I told them he lives in another state and doesn't have a phone the women got mean with me and asked for his address. I refused to give it to her she said she would just keep calling. My nephew went throught debt consolodation and paid it almost all off when the original company pulled out with 6 months to go. Now he gets calls all the time what can we do

Default What you can do about bad collection practices

If you contact your state attorney general's office, there should be a consumer protection division that regulates collection practices within your state. Most of the time, these companies are to cease calling when they find out the person they are looking for is not at the phone number they are calling. If they continue to do so, they are violating state laws and the attorney general's office is kind enough to inform them of such. Meanwhile, everything is documented so if collection attempts resume, it's a double whammy. Good luck.

Default annoying phone calls

I have been receiving phone calls asking for a person that I have never heard of. I have informed this company that they have the wrong number, but they still call. It is driving me nuts. Any suggestions?

Superior Asset Management is also operating out of Atlanta, Ga. They keep telling me that I owe an outstanding electric bill in Atlantic City, NJ which is not even my debt. I have told them this on the phone and no one listens. I was told that I was an ignorant ****. I consulted my attorney and sent a cease and desist certified letter with return receipt and it was signed for. They still keep calling me. I called them back last night and they told me they received nothing from me. The lady started screaming at me and hung up. I am having my attorney start lawsuit proceedings against them. They have harassed me to no end for something that is not mine.

If you have any problems, just call the lovely "Ms. Chew" at 1-800-587-4714. The number works and goes directly to Ms. Chew as of 8-11-07 AM.

It might be "Ms. Chu", but this woman is very clearly of African American persuasion. It was an odd call.

I could not even get a mailing address out of these scumbags. I was advised, however, to check with the US Dept. of Agriculture and Consumer Services by the ever-so-helpful Clearwater, FL Police. The lady who called me back from CPD informed me that "it was probably a legitimate claim." Puh-leeze. She would not tell me about any other complaints given to the CPD regarding this scumpany.

And to think that Bank of America (which is who Chew said held the original debt) would ever let their collections get auctioned so far down the road to such a suspect operation! What a shame!

I firmly believe that SAM are (knowing?) recipients of faulty debt information. How do you go to work for a company like that every day, defrauding honest folks of everyday means? Maybe the "employees" are all in on it?
