Rest assured, Ellis Crosby & Associates CAN NOT file charges or a lawsuit against you and by them treatening to do so is ILLEGAL. Only the original creditor can bring a suit against you and ONLY to obtain judgement for payment of your debt with them. For all you know, EC may not even have legal right to collect the debt. I would contact the original creditor and try to work out payments with them.

Furthermore, it is very hard to prove a consumer has committed fraud just because they defaulted on a few payments. EC uses words such as "internet fraud", "investigator" and "officer" to scare you into thinking you have committed a crime and the only way to avoid criminal charges and arrest is to pay them right then and there. That to me sounds like extortion, pay me now or else!

i have been getting calls from this company for months now one everyday the last few days a marvin wade just called me again and said they were on there way to arrest me and to take my works computer since i cant pay my bill.I have asked on several occasions to be able to pay this bill back and in payments to please send me the paper work so i can get it taken care of and all the response i get is good luck susan your in a lot of trouble and then they hang up on me .I sure would like to know what to do sence he just did it again telling me they were ont here way to my work to get me.what do i do

Basically just tell them that all incoming calls are being recorded. Listen to what they have to say, and then at the end, just clarify...isn't Mr Ted Crosby in a lot of trouble Marv? Hmm...yeah it's gonna suck having to pay a lot of fines in punitive damages. Oh..and for you Marv...what are you going to do. Flordia isn't going to honor unemployment. Have you started looking for a new job yet?

Be as creative as you want. But please do not worry about getting arrested. It is not illegal to be in debt, and obviously you want to make arrangements. Your post serves as proof.

thanks so much/they have been sooooo rude and mean and threating since my first phone call and i owe less than 1000 in which i will pay back but im not even sure how to do that .you know tho if your not use to this there phone calls can be very scary they say such threating things

Susan, you might be entitled to a settlement for the harassment. I believe it's $1000/person but someone said it varies by state because in Texas it's $100 per violation.

They've violated a lot of laws. Keep an eye out on this thread. I'm sure someone has the info you need to file a complaint.

I am so glad I found this forum. I am probably like a lot of users. I have been threatened about being sent to jail and very much humilated. I can't believe people actually work for this collection company. Are they that crazy? I am sooooooo.. sick of phone call after phone call.

Susan, I got the same kind of call from a guy named David Wakefield with Ellis Crosby. Apparently they use the same tactics on all of us. Next time, do what I did, tell them you are recording the call, I bet they will do what David did, he got angry with me and told me I had no right to record him, I told him I didnt care, I was recording him anyways, so he hung up on me. I havent heard from them since.

Only use the recording option if you want them to stop calling. It'd be even better if you had a tap/recording device. But if you do, don't let them know you're recording. All incoming calls have the right to be recorded...without being announced at first. I believe only when you're placing calls do you have to announce it.

This could be used in the criminal matter pending against Crosby if you chose to submit it with your statement.

i just called these guys back and asked if my attorney could call them at this number and if i could please have my account number and he said have your attorney call me and fax me a letter at this certain # he said i could not have my account number cuz its really to late and hung up on me.i called back and said i want my account number and not to be hung up on he said stop harrasing me my phone calls are being recorded and this is the second time you have called me in 5 minutes .stop harrassing me i said all i want is my account number and he then hung up on me

I too have went through all the samethings you guys have. I decided to seek legal help and as of today my attorney is filing suit against EC. I did pay my debt to them only what my contract said though. Now i have this other company calling me some ELIN saying that i owe them the debt now or they are going to take legal action. I sugest getting an attorney if you can. these people can not take advantage of us like this. I did pay my debt but i am not paying for it twice.
