Providian sold my acct to jefferson cap

I had an acct w/providian. They sold my acct to emerge (lie) because providian owns emerge. Who then sold my acct to jefferson cap, which emerge owns. Is this legal?

I think that companies are legally able to sell your account if it's way past due. I don't know about reselling, however. Providian has proven to be a HUGE pain in the butt for many people. My fiance owes about $1000 to them and just isn't going to pay it. They have been a pain, made numerous charge-offs on his credit report and their "late fees" are outrageous. What a corrupt "company."

Hi CURIOUS

Welcome to the forums. Any company that is holding your account legally should be able to validate the debt as per the FDCPA law. The creditors have sold your account to the collection agency by giving the necessary information about your debt. They should be able to provide you the following information received from your creditors. The following points will prove that the agency is holding your debt legally.

  • The details of the account.

  • All the calculation should be shown of the amount that is owed.

  • Any copies of the papers to be furnished that shows the payment agreement.

  • Provide a verification or copy of any judgment if applicable

  • The original creditor needs to be identified.

  • The Statute of Limitation needs to be proven for the collection of the debt.

  • The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent

  • Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.

  • Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.

  • A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

You can also check your latest credit report to confirm the latest standing of your account and take necessary actions towards your debt account.

Jefferson Capital is a collection agency that usually purchases charged off debts of the consumers from Providian or some other creditors. You might have to ask details about your account from Jefferson Capital purchased in the past from your creditors. You can contact them at one of the addresses given below:

I received a letter from an attorney in Massachusetts
stating that I owed over 2200.00 on a credit card. At one time I had a card from them, but it was a long time ago. That account was paid off 3 or 4 years ago and I never charged anything else. Why am I getting this now?

Hi Sandy

Welcome to the forums.

There might be a possibility of some clerical error in your account. Ask the lawyer to send you the account details in writing. After you have seen it, if there is any mistake, you will place it on dispute. They will verify it with your original lender and correct it. You do not need to worry on this so much.

You might be having that credit report that shows this account as ‘paid'. Also, you can look for those receipts of the payments made towards this account. These will serve as a proof.
