Check the state laws and if it is permissible, start recording the phone calls. If not, inform the caller that the call is being recorded before you start doing it. Present it to your lawyer and he will help you in filing a class action lawsuit against them.

Dave,
How did you cross reference this number to mortgage pointer?
They have been driving me nuts, and I searched many reverse lookups to no avail; also calling back the 866 number only gets a never-ending recording.

I believe this is a technique where a machine makes phone calls and records the time of day when a person answers the phone.
This technique is used to determine the best time of day for a "real" person to call back and get someone at home.
What you can do after answering, if you notice there is no one there, is to immediately start hitting your # button, this might take you to an operator or prompt your for more options since it is an automated phone call. You may try hitting the * button also. Anything is worth a try!

It will be also preferable to call the phone company and make arrangements to block the automated number.
I was getting such types of calls endlessly some time back. I didn't have any other way but to change my phone number.

Guest, read other's posts in this forum who are getting similar calls. Most of them have been able to stop them by sending a cease and desist letter.
If are sure that you owe nothing to the company, send a cease and desist letter giving it the utmost legal importance. The federal laws states that the collection agency must stop calling further after receiving your C&D letter. Send your letter through certified mail.

Well, as you all seem to know these people are beyond frustrating. Ive have told them twice a day (all calls after 9pm) for over a month, not to call any more, nicely, and not so nicely. They seem not to care, they hang up on you and call back a hour later. Seems there must be something that can be done about this. I dont need any service that they are solicitating. I can handle my own debt, etc. As for you people who are defending them, you must not be getting these calls or are the ones making them. Please cease and desist, get the point!!!!

You should send a cease and desist letter to the company's mailing address and stop them from calling you further.
A cease and desist letter is a very powerful and legal weapon by which the collectors can be kept in their best behavior. Read the samples of this letter available on this board. Once you have sent it in writing to them to stop calling you, they are restricted from calling you further. If they place the call after receiving your letter, it will result in violation of federal laws and you have the rights to sue them. Make sure that you have sent the letter through certified mail with return receipt requested. Doing this, you will be able to track the letter till it gets delivered. You can also track your certified mail through the UPSC website.

These people are driving me crazy too. I've told them to stop and they just call back within a few hours. I'm going to look for the cease and desist letter and try that if I can find their address. Would being on the No Call list for solicitors also work?

Deb, a template of the C&D letter is shown in the link below:

You can't stop the collection calls by registering in the Do Not Call List. They are for stopping all the pre approved credit offers.

That is crazy that everyone is having problems with the same mortage people bugging them late at night. I'm actually on the net now trying to figure out who they are to report them. They just called my house at 10pm and we wanted to talk to their manager and we told them we wanted to get them in trouble they said they would get us in trouble and give our info out to other people so that more people would call us..this is soooo crazy!!!!!!!!!

You must visit your local attorney general office and place your complaint against the mortgage company. They have directly threatened you of selling your personal information to others. The company is violating its privacy policies and you need to take strict actions against them.
Have you ever talked to someone live over the phone? Ask him the reason for calling you. If there is no valid reason, your name should be removed from their system.
