Getting call from a number but does not leave a message

What are the time frames that they are allowed to call? Are they allowed to call 7 days a week?

The collection agencies are allowed to place the calls two or three times in a week or if requested by the consumer. There is no such rule for them to call someone seven days a week. Sending a cease and desist letter is perhaps the best choice to stop all such frequent calls.

What I meant was are they allowed to call Sunday-Saturday, or are they restricted from calling on Sundays?

Also, what time frame are the allowed to call? I thought I read somewhere they can call you from 8:00am - 9:00pm, within your time zone.

Hope this clarified my questions.

The fdcpa law allows the collectors to call on Saturday and Sunday like any other day. But the important thing is that they are not allowed to place the calls before 8 a.m. and after 9 p.m. They can't repeatedly make the calls and use it for harassing people.

The collectors have to consider the time zones where you reside, not from where they are calling in case they are living in a different zone.

I went into their website to get their address, and miraculously two new bookmarks appeared in my Google search bar!! I would be careful of spyware ... don't go into their website!!

That is so gross that they would put that on your computer! Do a full scan and make sure they didn't put some kind of virus on your computer! It is probably some kind of identity theft scan--Calling people knowing they may try to research it online so they can stick spyware/viruses on your computer...Gross!

I too am getting these calls with no one on the other end. Who are these people? I would like to stop them. I spoke with Cingular Wireless and they are investigating the company.

We've had the hangups too. My "favorite" is the one that says, "No one is available to speak to you at the moment..Please hold for an important message." Then you sit and wait, then it disconnects. I'm always like, "Wow...I'm glad I heard that one."

Depends on the state you live in whether you have to have both parties permission. In the state I live in, I don't have to inform the other party of the call being reported.

Prior posts identified the source of the call/hangup phenomenon as the use of the computerized dialing system the [url=http://www.debtconsolidationcare.com/handle-collectors.html]debt collectors[/url] are beginning to use now. That system comes from a company called Universal Systems, INc. in Eden Prairie MN., and it's true, that's why it's happening. The computer dials more calls than can actually be handled, and hangs up on answer if there's no operator available right then to take the call. And the prior posts are also correct in that the "do not call list" doesn't apply to debt collectors, because they're not "telephone solicitors" as far as the FCC regulations are concerned.

There are, however, two things wrong with the debt collectors' use of predictive dialing systems. One, it may be a violation of your state law, particularly if you're billed for the call, to call and hangup repeatedly, because even though the caller's principle purpose is not to harass, they intentionally take action knowing that to be the result. Secondly, the Fair Debt Collection Practices Act forbids all telephone calling made in a harassing manner, 15 U.S.C. 1692D(3), and in that sense is much stricter than the regulations governing telephone solicitors. If you have informed the debt collector that you no longer wish to be contacted by them at all, then they can no longer call you at all, except for a few very narrowly defined circumstances, 15 U.S.C. 1692C(c). It also forbids making any kind of contact without meaningful disclosure of identity - 15 U.S.C. 1692D(6).

If you are being billed for those calls, e.g., on a cell phone, call your telephone service provider, explain what's happening, and ask them to block that number from calling you. Chances are, the debt collector has that number from a prior user who actually did owe someone money.

Ash, 28 (I believe) out of the 50 states allow the recording of conversations without the knowledge of the other party, you can find that information on the local attorney general's website, and the FTC website. I am in Texas, and according to the Texas Attorney General, we do not have to inform the other party that we are recording the conversation, and it will hold up in court. If you live in a state where it is required to tell the other party, and you do not..then it cannot be used in court.

the same number (866-432-0241) has been calling me as well. during school, at home, while i am sleeping. my parents refuse to do anything about it though. they have called me 3 times in the last 24 hours. i am getting very frustrated. any updated information would be greatly appreciated. email at email address removed as per forum rules - Mike
