Default Ellis Crosby and Associates

I just received a phone call from this company. Scared the s*** out of me."Investigator" Darius Hunt
told me I was facing all these felony charges for a $325 loan from FSM Group, and that I was going to be arrested either at my job or at home depending on where they could catch me. I was near tears. Something clicked in my head to look up the company online while I was talking to them. This is the first site that came up when I did a search.

How in the hell do they get away with this type of harassment? Who do i need to contact to complain?

MEO- please contact them and tell them that even though their membership has been suspended they are still making the calls and still doing it. Heres the website where they have been suspended and which you can make the complaint.
i Urge you to complain to this company as they will help us if enough of us complain, I know of 3 others who have done the same as well as myself. You can also complain to the ATTORNEY GENERAL.

Hi meosheat,

You can also lodge a formal complaint with the FTC and the authority will conduct an investigation. They will take necessary action so that these sort of illegal activities are stopped which otherwise harm the consumer rights of an individual.

Default Received a call from Ellis Crosby

today and boy am i glad i found this site. It doesnt sound like i should send them a dime. My loan was with FSM and if they wont take any money from me, what should i do? Not sure if it is a coincidence or not, but received a call from Liability Solutions earlier in the day. They had called my brother and a good friend trying to find me and told them both they would be subpoenaed (damn that is hard to spell) mentioning fraud. Are these two linked together and can they say that to my brother and friend. How can they involve them or are they just using their scare tactics? Thanks for the help

Welcome to the forums.

The creditor or the collection agency cannot treat your brother or your friend. Rather they cannot threat you for collecting the debt. They have utterly violated the fdcpa rules and regulation. Please consult an attorney who can guide you in this matter. In addition you can also register yourself in the debt consolidation program. After then the debt consultant will try negotiate with your creditors or the collection agency who can settle the matter. But before everything ask your creditor or the collection agency to validate your debt. They are bound to this as per law. Before the collection agency or the creditor can take any action they have to notify you and validate your debt. Please do not stress yourself out as the law is on your side.

Be sure that no one can recover money from you on false pretext. Their is a legal approach to everything and no company can violate the fdcpa law.

Default collection agencies

in the states of pennsylvania, texas, north carolina and south carolina the can not garnish your wages for personal consumer debt ex: credit card, loans
they can however for federal student loans, taxes, child support things that deal with local, state, and federal gov.

I can truly attest that PAYDAY loans are probably the worst option one can make when it comes to loans/needing money. I found myself in the payday cycle- and over my head. I ended up closing my bank account and defaulted on the loans---
---I took each one, as they came to me, and paid them off. I made arrangements and paid them 50-100 per pay check until they were gone However, since I had about 12 outstanding loans, many were coming at once.

** However, after paying off a few of them I realized after doing tons of research on not only payday loans, but collection tactics, that I was being taken advantage of.

** Most of the companies farmed the collection off to another agency. I have also been told I was going to be arrested "for writing a bad check", told the police were going to arrest me at work and to watch out, that my wages were going to be garnished, harassed my family and co-workers etc. In addition, these companies would tack on hundreds of dollars to the balance I truly owed and could not prove the actual amount I owed (for instance saying I owed 1200 for a 300 loan)

THIS IS ALL AGAINST THE FCPA--- and now I have a lawsuit pending against a collection agency for their tactics on collecting the debt. And I do not care about the "measly" 1000.00 I can get, its the point.

-- I was so scared, if I had the 1200.00 right then and there I would of paid it, and now I know that not only did I not owe the 1200.00 but they used horrible lies to scare me.

----Now a few of the companies have been reputable, say I owe 315.00, and that I can understand, with no threats of being arrested. And I happily paid them.

** Payday loans are interesting because you are dealing with a post-dated checks. Even more I dealt with online companies who never received a check from em at all! The collection agent tends to tell you you wrote a "bad check" and therefore since it bounced you will get arrested. But understand that by somone accepting a post-dated check they are acknowledging that the funds are not there at that time (hence accepting a bad check), that is why the "arrest" threat is empty ( check your state laws )

----In closing- I am a firm believer in paying my debt. Just because I owe a debt, does not mean I should be taken advantage of---

I suggest all people who need money assistance to really think about it before the get a payday loan--!!!

And lastly, if you are dealing with a collection agency- whether nice or mean, I strongly urge you to do a search on google on fair collection practices and become knowledgable about your rights.

It's nice to hear from you back. I went through your post and found that you have also gone through the same kind of profane situation like many of us do.

I am also glad that you are well informed of your legal rights and responsibilities and specially your responsibility to your past debt. It's nice that you have successfully paid them off and now you must have been able to remove the negative markings from your credit report.

Also, I anticipate that you won't be dealing with payday loans anymore as you must have learnt the adverse affects of it. They tend to be the easiest available cash but their hidden interest rates are sky high.

Thanks for sharing your valuable piece of experience with the community and we do look forward for more support from you for the community which is trying to recover from the financial problems.

HELP!! I recently took out a payday loan, and when a payment was put through my checking out, the payment was declined. I had a debit card stolen and the bank closed the account. Before I could get things together, I got a scary call from an "Investigatore threatened me with "sequestration:" an stateattorney general Charges of bank fraud. He also called my employer and my ex husband! When I have attempted to call him back, i can not even leave a message. I finally contacted my attorney, who explained these scare tactics to me. When I Western Unioned the $$$ to the code city that the "investigator" gave me, the payment was declined. My attorney assured me that I will not be arrested. I just want to repay the money, but do not even know how to go about it!!

Help!!

They CANNOT ARREST YOU!!!! AT ALL!!
Ther reason your payment was declined is because there is an ALERT regaurding them and they are not allowed to collect any moneys at all, until sept1, they have been suspended but they are trying to get money because they have fears of being shut down and they want to get a paycheck too...
I called all my loan companys and told them that i WILL not under any circumstance send Ellis and Crosby anything, and they told me they cannot take any payments from me. I said then you might not get paid, bc i refuse to pay liars...
DONT GIVE THEM A DIME! :shock:

Yes, what Katie has told is absolutely correct. They are undergoing legal surveillance and they cannot collect debt from people during this time.

Do not get afraid. Nothing will happen to you.

Payday loans seem like an easy solution, but instead you end paying back more than double than what you borrow in the first place. It is such an easy trap to get involved in though. When I found my bank account in the hole, borrowing $500 seemed like an easy solution. It was, but then when it came time to pay back that money two weeks later, I found it impossible. Having to pay the fee to extend the loan caused a lot of problems for me in paying my bills, and paying for transportation and food, causing me to borrow from another lender and so on, fully engulfing me in the payday loan trap. I wish I would've never got a payday loan ever in the first place, but now I'm stuck. It is extremely important that we all work to educate teenagers and young adults the importance of staying away from payday loan companies and using all credit wisely, so they don't end up like me and others in my position.
