Can they do anything to you for defaulting on loans? Im working on paying them back but i cant pay them all back at the same time. I am working on 4 out of 11. The Bank closed my account and im just worried that they are going to come and take me to jail, even though im not the one who closed the account in certain states if you close the account, i HEARD, that they can jail you.
Whats the rules for texas does anyone know? if you obtain the loan in texas do the laws fall under TX law OR the state the loan company is orginated in?
Any information would be helpful.

These are all internet payday loans so i didnt actually give them a written out check just a voided one.

Do an internet search on the PostDated Check laws for Texas. I don't think that there is any merit in stating that they will take you to jail. You sent them a voided check, which does not represent you claiming to have funds in that account. Being in debt is not a criminal offense, and for a creditor to state otherwise is a violation of your rights through fdcpa. It may actually be a blessing in disguise that your bank account has been closed. Realize that these "loan -sharks" are going to try every scare tactic known to get you to send payment in full. If you are able to pay one off in full, do that and then do the next. If not stick to your payment plan and say good riddance to these costly loans once and for all!

These companies were aware of the fact that you didnt have the money in your account. Because it is post dated, as freeman has stated in most states is not a criminal offense. I agree with freeman stick with your payment plan, dont let these people scare you. I have been through the same situation and most have been able to work with me. There are a few that refused to make payment arrangements.

I seems like the payday loan people that are in the Us are the ones that are willing to work with you.I had one payday loan that will not give me an address,they said I had to send a payment by western union,all the others gave me an address with no problem,and were very happy to work with me.But,I was wondering,it your willing to pay,and they refuse to give you a mailing address,do you have to send the money by western union,which cost money,why are they afraid to give out thier address?

I had the same problems with Sonic. I told them that because of fraud, I was NOT willing to send the payment via WesternUnion. If you stand your ground, you will get an address you can use. You could even let them know prior to your request that you're recording the call for documentation purposes.

If a company does not end up giving you an address, even after searching high and low for it, you'll probably end up getting hit on your credit report (if its still unpaid).

Do to filing a complaint with the Pennsylvania Attorney General, Sonic has agreed to $50.00 a month. Waiting for physical address. I stated to Sharlene Chandra that once I had a legit physical address And was checked out through the attorney generals office, I would begin payment. Still waiting for a actual physical address. Funny thing about the email was it was signed sincerely, Sharlene Chandra but under it in small letters Erin Kennedy. I am wondering if Erin Kennedy is using the name Sharlene Chandra.

Erin Kennedy is a supervisor. Sharlene Chandra is the manager over all the supervisors.

I'm not sure about that one.

Perhaps it's the way she types out her email, or maybe it's their system that also puts the other people involved in smaller lettering.

It's good to hear that this is getting taken care of, but only after having to make the complaint.

I was told by this company that being that I did the loan online that I was subject to felony charges which they threatened to get intouch with my HR department to have my hard drive taken as evidence, they really sound profession and I don't know if they are true or not, but I would like some answers on this company

i have about 5 payday loans and now they are saying that they are going to take me to court and pursue this as a hotcheck now im getting scared....... any information would be really great........ what do i do cant i go to jail........

They are lying, payday loans cannot be considered a hot check and criminal prosecution is not possible
