Another Payday loan paid off and I can't get a letter sent to me stating it's pd. I can't find them anywhere and now another collecting agency is trying to collect on the same debt. There name is First Credit of America has anyone heard of them? What can I do to stop all of them and get a confirm that this is paid in full.

Call your payday loan company and get the actual standing of your account. It is their duty to update your file with the bureaus. Send a letter to them explaining that the said account is not reflecting your actual credit history.

Regarding the collection agency that is contacting you, send a debt validation letter to them requesting for the complete details of your account. You need to know first if they are the actual holders of your account. Later on, you can send a letter to them saying that the account has been paid off and updated in your credit report. Thus, they are required to stop collections. This is their contact information.

They are in legal trouble in the state of Illinois. Do Not send them a dime without proper validation from them.

Lori, I am assuming that you are looking for the companies whom you want to pay your past accounts. Check your credit report and see the latest status of the accounts. You will be able to get more information about your creditors and the account details or if they have been forwarded to collection agencies.

Creditors can garnish the wages if they intend to do so. But, before it is done, there are many things that are taken into consideration. If they feel that they can get the money without the legal procedures, they won't apply such legal actions.

Call your credit companies and make payment arrangements with them. Dealing with creditors will be quite easier than dealing with collection agencies. Run a credit check and know the companies entitled to receive payments from you.

one of my payday loans have been sent to a recovery service they wanted 200 now i couldnt do it i told them i could do 100.they said that wasnt acceptable and that they would have to pursue further options..then they asked if i had an attorney i would like them to deal with.......im in texas can they put me in jail

Tracy, no payday loan company or a collection agency can threaten jail arrests as this will go against the fdcpa violations. Besides, you can't be sent to jail for not paying the debt. Most that can happen to you is that your wages might get garnished from your payroll department. But before it is done, they will have to get orders from the court and you will be asked to present your case.

Contact your payday loan company and explain your difficulties faced with the collection agency. Advance some money after lay a proposal to them. It will be much easier to deal with your lenders than dealing with the CAs.

i thought in the state of texas they cannot garnish wages only for irs or child support , welfare....... and since they asked me if i had an attorney i guess they are planning on taking me to court right

I was told by Bud Hibbs to send a validation letter to them because I have yet to see a validation of the acutal amount that I owe. You are right, in Texas they cannot garnish your wages. I live in Texas, too. I also reported them to the Attorney Generals office as well for their threats. They told me that they were going to pursue me legally for a NSF check. Funny thing, they don't have a NSF check from me, just where they kept debiting and debiting my account until WAMU closed my account on me. Because of FSM Group,Cash Today and Pinion Management doing this, I can't get a bank account at any respectable bank now.

yeah i went through that too it got to the point when i was 800 overdrawn and i never sent a check either... they would just debit....so i switched banks then paid that bank off after they wouldnt let no one anymore take money out and now that account is closed.so if i send money orders everyweek can they refuse it until it is paid off

I was told by Certified that the only way they could work out a payment agreeement is if I did a check by phone. They wouldn't even take a debit/credit card. My thinking there is that they want only a check so if it bounces they can come after you for a real NSF. Plus these companies will just debit and debit until their little hearts are content without even asking or getting your permission. When I would tell them they had no right, they told me it was in my contract that they could debit as much as they wanted.

Never give a collection agency a check. I learned the hard way. They took the account number off of the check and debited our account the amount owed. Thank goodness the bank was on their toes and reversed the charges and credited it baack to the account. Acording to our bank, the person debiting the account has to have written aurthorization before they can debit.

im thinking about just sending about 25 a week to us faast cash and start paying them off but im not sure theyll take it

Have everything in writing before you send your money. It is important to have a paper record so that you can prove your case if the matter ever reaches the court.

The federal laws state that the collection agency must send you the debt validation details after you have asked for it. If the company does not give you these details and still call you, you can file charges against them. Consult an attorney that specializes in lawsuits of fdcpa and FCRA violations.
