I currently have a loan through ameriloan that now is in default but I think something might be wrong cause I haven't heard anything from them they usually send me a letter in the mail but I haven't even gotten that so I don't know what is going on with them!Does anyone have a telephone number to reach them at?I think I need to call them before they try something stupid!

Well, some companies basically, after many tries, gave into me making payments. However, this is when most went into collections. 3 companies worked with me directly (quikpay day, sonic payday, my cashtime) I was able to pay each about 50-100 every two weeks and did each one at a time. They are now gone. Yes I did pay more then the actual loan due. And this was before I was knowledgeable about my rights. however, if the account is still with the origional loan company, again, they do not have to negotiate anything with you and they are not governed by the FCPA.

Here is a word to the wise. I took out several of these loans for the purpose of having "play money". I never defaulted and afforded the intrest payments but never really realized how I was dwindling what should have been my positive cash flow. I could have afforded to pay these off but rolled them because it was easier. I stopped a debit because I didn't recognize the name of the debitor(it was a processing co for the lender). Needless to say less than a week later, I received threatening horrible calls- scared me silly- and I paid well above and beyond what was due of me(no, it was not EC). What a wake up call! I had no idea how feverently these agencies work to collect on defaulted loans. I had 4 remaining loans and I made immeadiate arrangements to pay them in full on the next due dates. I sold personal belongings, took a loan from my mom, and got rid of them as quickly as I could. I didn't sleep or eat for weeks because the experience with the collector was so degrading and humiliating. Now that I have escaped this trap, I will never ever take out one of these loans again. I actually worked with some good companies with great service. However I saw what can happen if you get in trouble all to clearly. I opened my eyes- taught myself in a hurry how to budget and cut corners, got a second job, and I am building up my savings slowly but surley. Please, whatever you do - don't take these loans out UNLESS YOU CAN REPAY THEM ON THE FIRST DATE DUE!!! There are other alternatives. From what I have seen reading these posts, many of you are experiencing this 10 fold. I am so sorry that you have to endure this but do everything you can to pay these bills and be done with it!

Thanks for the heads up!! I am happy that you have recovered from the painful situation and that you feel regretted for taking it.

Thanks Ben, these forums were a great help to me. They taught me not to be scared, but also exposed the pratfalls of these loans and the like. I will note that there were some really good companies I worked with and every one was great in helping me to pay in full- with no problems as of yet. If I defaulted any further I probably would have run in to major issues. My point is that you MUST be responsible if you choose these loans, and if you know you can't afford them, JUST DONT USE THEM!!!!!!

This is very true. Payday loans can be of some help during times of emergencies and the lender knows it very well of how to take advantage of our hard times.

It's better to go through the hard times rather than taking the payday loans. It makes the future even more darker and fearful.

I don't know what to do. I have received numerous calls both at work, at home and at my parents from three companies-E-Max, Attorneys Ellis Crosby and Associates and Allen Lewis. They told my family that I was under legal observation and that I may face jail time if I do not respond. All three are telling me that I will be arrested for Check fraud and for Malicious utterings under Chapter 832 of the Florida Law. They have told me that warrents have been issued for my arrest and that any day now I will be p/u for non payment. I called the State Attorneys office regarding Ellis Crosby on the advice of an attorney and have filed a complaint. The State Attorneys office transferred me to The Dept of Financial Services regarding E-Max where I was told that they are not even licensed in Florida. I don't know what to do anymore, I suffer from a stomach disorder and lately it has been flaring up more than ever. The doctor tells me to control my stress but that is impossible with all of this going on. I have tried to work out payments with all three but have been told that it is all or nothing. I have not received anything in writing from any of them. I am scared, upset and sick over all of this. Where do I turn?

Hi Knee,

Welcome to the forums.

Please do not stress yourself to the extent that you fall ill. Ellis Crosby is undergoing legal actions and they are trying to scare people in order to recover the debt. They are out of business and you do not need to pay them anything.

If they are asking you to pay anything, ask them to validate the debt. Samples of debt validation letter have been kept in this forum.

They can't do anything beyond scaring you. Make use of your consumer rights and file your complaints against these harassments at the FTC, BBB and the state attorney general office.

Please do not panic over this issue and I am sure that you will feel stronger after reading related posts about the said company in this forum. You will be able to take the stronger side of yourself and fight back.

Because of fraud activity against my checking account, I was advised by the postal inspector of Las Vegas , to close my account. I have several payday loans, I informed them that I was going to close my account and set up a payment plan to get them paid off. I did not want my new account subjected to the payday loans coming into the account. How do I get help with defaulting on these loans. Are there any credit consumer agencies that will help? Because of the fraud, I have fallen off but I am willing to pay, but I cannot pay all at once! ANY ADVICE?

You can contact some CCCS and see if they will be able to work on your payday loans.

These days, most of the companies are not willing to work on payday loan consolidation. I guess it will be more realistic if you set aside a fixed amount and pay towards your debt. It might be a slower process but you will have definite results.

I wanted to thank you for your help yesterday. I have file a complaint with the BBB and the State Attorneys office in regards to Ellis Crosby and have begun looking into Allen Lewis and E-Max a bit more to see if they legally able to do what they are doing. E-max called my mom last night at 9:30 and told her that they were looking for me and had a warrent for my arrest. She called me crying. I explained to her the information I found on your sight and it helped her to understand. I know I have a battle ahead of me as the original agencies keep referring me back to Ellis Crosby explaining it is out of their hands.
I explained to the Dr. what is going on and he has given me some ways to help keep my illness under control during this stressful time. Thank you so much for being supportive and understanding and for providing me with the tools I need to find a way to pay what I owe and not be harressed and belittled.

I am so sorry to hear that you are going through so much stress, and from someone who was in the same position, i can assure you it only gets better.

Keep in mind these collection agencies use our guilt of being in debt to scare you. The tactics they are using by threatening jail/fraud charges, arrest etc. are completely illegal if they have actually no intent or ability to do so. You may want to check into speaking to an attorney on your behalf. Especially if one of the collectors was "dumb" enough to call your mother and discuss this issue with her. That is also a violation of the fcpa. Check out consumer attorney's on the NACA website. You should be able to find an attorney who would take your case without any fees upfront, or at least someone who can inform you legally of your rights. INfact, a lot of their websites are quite helpful to read.

Knee, you just have to feel stronger while dealing with people from Ellis Crosby. They are in violation of every law and are trying to intimidate people. Take the stronger side of yourself and ask them to prove about any debt that they claim. You are willing to pay if you have a due but you should have something in written for that. You can’t pay to a company that will pocket your money.

I have 6 payday loans. I am interested in how some of you with more than I have start paying them down. Do I call of them and make an arrange or should I start with the lowest loan and make an arrangement one by one. I have been getting alot calls, and some are willing to work things out but I can afford to do two or three at one time. CAN ANYONE GIVE ME ANY ADVICE ON THE BEST WAY TO HANDLE THIS. Some of the payday may have already gone to collections. I did call of them intially to try and arrange something but it was to the point where I still could not handle getting paid. NEED ADVICE QUICK

Welcome to the forums. Your best move to solve the problems with your payday loans should be to negotiate with your lenders for a perfect payment plan. Write a letter to them expressing your desire to set a plan so that you can make monthly payments and thereby erase the debt.

You can first arrange with the ones that have the highest rates of interest and simultaneously work with the one that is of the lowest amount.

Make sure that you have reduced your monthly expenditure also by following the perfect budgeting method. You will see that your contributions each month will help in completing the payday loans and thereby achieve a debt free life.
