Welcome to the forums.

It sounds that the said agency is trying to do some fraudulent activity on your accounts. Be sure to get your debt validated before you consider making any payment.

I feel that the invoice that they are sending at your mailing address won't be sufficient enough for debt validation. Samples of some debt validation letters are kept in this forum. You can send it to the company after you have got their address and put it on dispute.

BTW, I would suggest you to keep an eye on your credit file and your bank accounts also. You can take immediate actions if you remain alert.

The number comes over as blocked so I can't get it. I do have two recorded messages from them that I kept, one from Mrs. Atler (who by the way sounded just like the receptionist when she called) and the other from a Dale Whitman, I will use it against them if necessary. If I can get any other info on them I will use it to nail them to the wall. I will never get involved in payday loans ever again. Also, I'm another Detroiter... Thanks!

The only banking info they have is my old one, I refused to give them new information. I'm going to call them back, tell them I'm on to them. I did see your debt validation letter and will send once they give me a legitmate letter. I dealt with ART, I sent them a Cease and Desist, when I spoke with her yesterday she asked what I thought I owed and I told her 260.00 and would be willing to pay that but I would not pay them all these horrendous fees they are asking for. She said fine and I said I would work with her. She is the one who told me about Interstate, under no circumstances not to work with them. I'm just waiting for the invoice we'll see if I get it, I think in the meantime I'll call them a hundred times a day and see how they like it, every 20 min or so.... Thanks...

ART is a good collection agency to work with. Many people here have words of praises for them and I will suggest everyone to deal with them if they are holding the accounts.

Though, it is not good to see an account in 'collections' in the credit report, but this happens because of the hard times that we all go through. So, agency like ART is one of the good ones to deal with in these times.

I just want to let you know that I have tried dealing with Acoount Receivable Technologies and found out that they are not legit. They will not validate a debt and they are charging ridiculous fees similar to El;lis Crosby. They are located out of New Jersey. The woman told me I owe $1700 then I said that I am not paying it and will send a cease and desist letter she started to drop the fees to $1000. This company is definitely not legit. They are just trying to get quick money out of us and pull off another fast one like Ellis Crosby. Please be careful.

Hi Dale,

Thanks for the info. I will support with you in your situation and request you to stay strong. In such a case, you should definitely use your legal rights guided by the fdcpa law. You have the legal rights to see your debt validated when requested. Also, you should get in touch with your bank and see if the fees can be waived off.

Hi Lori,

A payday loan company should not call you at your place of work unless you have defaulted in making payments. However, if they are repeatedly calling you, it needs to be stopped for better reasons.

Though you can send a cease and desist letter to them as it is send to the CAs, but not all lenders are legally required to follow it.

At this situation, I will suggest you to contact them and see if any arrangements can be made towards repaying the loan. Insist on a payment plan and stick to it so that they get an understanding that you are willing to clear this debt faster. Most of the companies do work out a payment plan. So you should definitely place and call and avoid all these unnecessary harassments.

I emailed my payday loan lenders,and asked them to remove my work number from my records,I have not received any calls at work since then.Im sure there are some out there that still will call,but its worth a try.Good Luck.

They can take you to court and try to garnish your wages,but they cannot put you in jail.If you call them and try to make payment arrangements,some of them will work with you,and let you make smaller payments.

Is it legal from them to make a threatof wage garnishment whern Texas is not a garnishment state?

Legal Mediation Practice in fact has made a threat or wage garnishment, jail, etc what can not done. I wnted to work something out but the claim they need my checking account or credit card # to do business and refuse to send anything in writing.

In Texas, wage garnishment can not be made unless it is the repayment of a IRS, Federal Student Loan or Child support payments.
I personally would advise against giving your credit card or checking account number to them. Have you tried sending them a debt validation letter via certified mail? There are several examples on this site for a validation letter. Explain to them that you are willing to repay the debt after they provide you with a breakdown of principal and interest along with payments made thus far. Let them know that you are willing to pay via cashiers check or money order only.
Roxette had some good advice to learn your rights under the Fair Debt Collection Practices Act. This way, you won't be scared by their ruthless tactics, and can protect yourself from making payements that aren't owed, or might not ever show up as credited to your debt.

I currently have 4 payday loans outstanding. I had to close my bank account due to fraudulent activity. I contact all 4 lenders immediately following asking for another method to pay them. One company was extremely cooperative and told me that they will waive my fee and "at my convenience" I could mail them a money order for the balance. Another company has never responded to me even after they've attempted to take the money from my closed account. The third company has told me that I have to pay to have the money sent western union immediatly to avoid garnishment. And the 4th company has been calling me at work telling me they want the money immediately! I cannot pay them in full immediately...they refuse to accept a payment plan. What can I do?
