Vincent, please read the article at the page given below and know the changes made in the bankruptcy laws. The new laws came into effect from 17th Oct 2005. It stresses the need to undergo a credit counseling program before finally taking bankruptcy.

Every individual has a separate credit file. If you have filed for bankruptcy, it won't affect your spouse's credit UNLESS you have signed a contract jointly for any of your past debt. If the creditor realizes that you are unable to pay your debts signed jointly, he might report your bankruptcy in your spouse's file.
