| Okay, well I have not gotten a letter. But I did recieve a phone call and then I looked at my credit report and under this debt is CACH, LLC.. I had a car loan with Household finance and I was late 2 months and they sold it off, to a law firm. Well I was making payments to the law firm for around 6 months well in May the payments stopped coming out of my account. Well I guess the law firm sold it to CACH, LLC. What do I do, I don't want to start making payments to a weird company and from what I read CACH, LLC is a weird company.. I am freaking out about this. Someone please help! |

I'd say first thing is to send a debt validation letter to CACH. Of course they probably will ignore it but send it anyway along with a cease and desist and make sure to send it return receipt requested. (that's very important) See what happens from there.

They are evil, I have been sued back in December 06, ang how long did it take you to get a court date? It has been a little of 8 months now since they filed the lawsuit and still no court date. Making me think this was just a ploy to get me to pay. Anyone have any thoughts here. _________________ Working my way out of this debt, one day at a time! |

CACH is a collection agency that purchase old debt, then tries to collect on it. You can visit bud hibbs and do a search on them or google them here to get more information on them. I haven't heard from them in a while (knock on wood) probably be something in the mail tommorro after writing this, LOL. _________________ Working my way out of this debt, one day at a time! |

| I received a summons today from CACH.LLC vs. me for a credit card debt. I understand that they buy these debts from companies, now what is my obligation to them? After all I did not sign a contract with them. Are all accounts transferable to other companies. What will happen when I go to court, I do not have the full amount to pay this debt, can I pay what I can in installments?. Give me some info on this please. |

Have u recieved a summons from CACH? If so, plz mke SURE to answer it in alloted time or they will get a default judgment! Depending on what state ur in, they can garnish ur wages to pay this debt back.

Make sure you have them validat the debt also, you need to find out the statute of limitations in your state and make sure it is not past that date also. Make sure you check this out before you pay anything, if it is past the statute of limitation they can not collect on it. Make sure you have them validate the debt, there are examples on this site that you can use. Send everything certified, return reciept requested. Fed, I am not trying to do one up on u plz dont' take it this way but just cuz a debt is out of SOL a collector CAN still collect on this debt they just can NOT sue u for it!! A collector is able to "try" to collect on a debt as long as it is still owed. But they can't win a judgement if it is out of SOL... This wud be ur primary defense on such a suit! So, in other words, they can try to collect but they have NO legal help in the matter!

Gosh the post i replied to makes NO sense to me after re-reading it now! ha ha
Ok, if a collector has a debt that is out of SOL and sue u for it, ur defense wud be SOL and then thrown out of court! But u MUST answer the summons and use SOL as ur defense! Whew! Make more sense now? lol Hope so....
But none the less, they can still continue to "TRY" to collect on this debt but it's almost a moot point since the court will not be on their side.. In other words, if u chose NOT to pay there is NOTHING they can do to make u pay it!
Maybe harass u with fone calls but that's the extent of their threats!

| My husband was served a summons and went to court. He asked for debt validation and last week Cach sent a couple copies of the credit cards bills as well as a signed statement from providian saying that my husbands debt has been turned over to Cach. Anyone have any suggestions on what to do next? Court is in Late October. SOL is up Feb 2008. |

Did u answer the summons? Cuz most times their work is very sloppy and u can dispute those things... Like an affadavit of someone who knows about this debt, that's hear say...
