Chances are they will settle out of court, you see CACH is a junk debt buyer and if you were to request validation in court as a motion to show cause they wouldn't be able to show cause and the case would be dismissed.

You really seem to know your stuff. On a $1500 debt what do you think CACH paid for it? If I wanted to settle and not go to court what do you think I could settle for? It would be nice to have an idea what I could begin the negotiations with. I'm used to the negotiation part as I do that for a living but not in the area of debts. Your help is appreciated!

Depending on how old the debt is you might be able to go as low as 50%, sometimes lower. They paid very little for that $1,500 Probably between $45-$300 Speaking of which about how old is this debt? When was the last time a payment was made on it?

The complaint state the contract was breached on 5/31/05. Is that old enough for them to have paid very little? The attorney's office called and left me a message on Friday. I'm assuming the process server notified them I was served. The requested I called them back and I will I just wanted to know what I was dealing with first.

It's hard to tell, it' almost 3 years old so it could have been sold to a debt buyer by now. I suggest you answer the complaint/summons.

I thought CACH was a debt buyer? Do I need to hire an attorney to answer the complaint? Can't I request an extension to file from the attorney and send the attorney the request for debt validation?

You would have to pretty much serve the attorney with the debt validation as a interrogatory during the discovery phase in a motion to show cause. They probably won't be able to produce the information requested (I would suggest using the validation template in my signature) Once they fail to to show cause, simply motion to dismiss with prejudice since they will fail to show cause.

You may wish to get an attorney to make the process easier. You can start with naca.net it is a good place to start shopping around for a attorney.

Thanks - I will start with the validation ltr and see how that goes. For a $1500 bill I hate to retain an attorney and pay that much or more to settle. I'll keep you posted.

I faxed and mailed certified the Validation letter on Tuesday morning. They had called and left messages on Monday... CACH / atty has not called since I sent the letter. So I'm hoping they will provide the requested information as requested via mail.

I recived a 1099-c form Cancellation of Debt from CACH,LLC. I'm not sure why. I have my credit report and they are no where on my report. Should I still file this on my taxes. Confused Confused And what exactly is this form.

We're dealing with debts that are now 3 years old and I noticed CA state law says 4 years is the SOL for collections (no payments have been made) CACH is on the credit report as the collector but we receive a substantial number of letters from different law firms, sometimes on the same debt item. What happens after the 4 year mark?

Once the statutes of limitations has run on a debt it becomes time barred, meaning that they cannot sue for it. If they do file suit after that time you can claim the SOL as your defense to have it dismissed.

After 4 years can they continue to report the debt on your credit report? Will it continue to impact your credit score?

The Fair Credit Reporting Act gives a 7 year reporting period, following which the item in question must be deleted per FCRA.

I recieved a warrant i debt from a law office in a county that is a 7 hr drive from my house with a court date in april. When I called the law office the lady said that she would have to notify the court and have the court case moved to my town. She told me that I could set up a payment plan and mail this lawyer a check for cach. I don't understand why they can tack on all of the interest they want to and can't work with people that have devoloped a hardship. my debt has doubled and the interest still is climbing I will be glad when I get to go to court. I called several debt consolidators and they refuse to help me because this lawyer sent me the warrent.
