You may wish to contact that county's courthouse yourself and motion to dismiss due to improper venue. I don't trust them, it sounds like they may try to dupe you and get a default judgment. _________________ Regards

I just found this site doing a search for CACH, LCC.
My parents both got letters from them today concerning debt that they claim my parents owe to a bank in Maryland that they have never heard of or done business with.
There were also some account numbers on the letter. My mom checked her account numbers to every credit card they have ever had and nothing matches.
From what we are figuring-this is some huge mistake.
My father has had his identity stolen in the past and our mail is stolen on an almost daily basis. Anything seems possible with this.
We were just curious if anyone else has encountered this situation.
Also, we were curious about what a SOL is.
We would appreciate any help. Thanks! _________________ Register today to encash debtcc points. |

Welcome to the forums Kat.
The first thing you may wish to do is have your parents check their credit reports, you can use annualcreditreport.com, it is a site that goes through the Federal Trade Commission (which you are entitled to 1 free viewing of your report per year from each of the 3 major credit reporting agencies. Once viewed I would suggest saving the webpages and printing it if possible)
In case of identity theft you should have both of your parents file police reports for such and contact the 3 major credit reporting agencies to possibly place security alerts on their reports. They should also dispute any entries for this account on their credit reports since they may have been a result of ID theft.
Lastly have them send a debt validation letter to the collection agency to dispute the debt (include a copy of the police report) you can find a debt validation letter template via the link in my signature, send it certified mail, return receipt requested.
If you have any further questions please feel free to ask. _________________ Regards

Thank you so much. We had no idea what to do, but my mom is going to look into doing all of that. (= _________________ Register today to encash debtcc points. |

Kat, have you/parents looked into alernative mail delivery arrangements? A PO box doesn't cost much. Cheaper than deling with this type of crap. _________________ Wulfisms: my blog

I have just read some of your older postings and I am getting chills. Cach, Llc has also been harrassing me. Like I am a little child that did something wrong. I am astounded to see that all of the attourneys offices that have been hounding me are alll related to Cach ! Cambece Law office. Scott Lowery Law office, what about Blatt Hasenmiller Liebsker & Moore ? _________________ Register today to encash debtcc points. |

No. They cannot take your home for a CC debt.
Give us some info here, if you would... How old is the account they're hassling you about, what state do you live in, and when was the last time you made a charge or a payment on the account? I gotta go to work in a bit, but some other good folks will be along to help out directly. Let's kick this around a bit, and see what falls off. _________________ Wulfisms: my blog

| Ok, a few years back I had a chase card. The limit as low ($500) so in nov. 04 I called their payment center gave them payment info over the phone told them to pay off the card and cancel it. Never heard anything from them again. Recently I found out through a state case website that there is a case pending against me file by none other than CACH LLC. Turns out they tried to subpoena me a couple of times as well. I moved last december and just recieved a forwarded mail dated january from CACH about the debt. Now before messing with those a-holes i looked into past bank records. Sure enough chase did not apply the payment or cancel the account resulting in a $500 limit card having a $1,200 balance. Until recently the credit report thing i used only had transunion (CACH reported to the others but not them)so again didnt realize i still owed. What is the best way to address this to CACH do i send a debt validation request, knowing the debt is valid? and is it possible to negotiate removal of them from my credit report? |

Validation is good for more things than just seeing whether it was your account or not. Ferinstance... How did they arrive at a figure of $1,200+ on a $500 limit card? And, do they even have the authority to be collecting on this account? I'd send'em a DV letter, just in case, but it won't stop the suit. You'll also need to request validation in discovery. Five bucks says they can't validate. _________________ Wulfisms: my blog

Ok, hold on right there. If they did not apply your payment that you sent them then they dishonored the contract, which is now null and void. _________________ Regards
