| If Chase sold the account, they are no longer allowed to accept payment, and will most likely return the payment, or you will never see it again. Chase has been paid by CACH for the account and will no longer deal with you. I have an account with CACH though..once you send that validation letter, you will never hear from them again, and they will sell your account. That is what they did to me. By the way, the people at CACH are major jerks. |

| CACH will not validate the debt, they will send it back to the OC, who will then turn it over to another CA. That is my experience with them, on more than one occasion. |

| Hi, i just recieved a letter from an attorney law office who, im guessing, works for CACH, LLC. This is what it says on the letter as the creditor. In the letter it states i owe them money and that when they get a written statment from me that they will send me the name and address of the original creditor. The debt i know, is thru best buy(bought a laptop for school but lost hours at work which means less pay) I live in texas, and i got the laptop in may 05 made payments until about oct, then had a job change and then the hours, i have been recieving letters from best buy about the payments but never had enough to start mailing the payments. This month has been better and i was going to mail a payment to best buy but now im not sure where to send it. The letter says that i must pay in full or legal action will be taken. Im sending them my letter tomorrow, but do i have to pay in full now? (dont have it) in the letter i stated taht i would like details and what about a payment plan. Im freaking out here, any advice on what to do? |

| Mary, after you have got the details of the account, send your payment proposal in writing. You might have to negotiate with them but ultimately you will send what you can afford. Make sure that you have proof of the payments done to the company. Send your letters through certified mail. |

| I sent a letter to the attorney for CACH,LLC. They received it because I got the return receipt where they signed for it. But I haven't heard from them since they received it, no phone calls, no acceptance or rejection of my offer. I got copies of my credit report from all 3 credit bureaus and it shows that Chase has charged this account off. Do I continue to pay the monthly payments that I have been sending? I want to pay my debts but I don't want my money to go to someone that shouldn't be getting it. |

Hi Cindy
As you are aware that your money should not fall into the wrong hands, the company must give you the necessary account information. These documents will prove that they have been authorized to collect the debt from you. Besides, you have the legal rights to refuse payments as long as you are not given the proper details about your accounts. |

Hi,
Just wondering if anyone has any idea what to do in my case.
Cach LLC has an attorney out of Houston TX that is suing me. I have already been served the papers and now have 20 days to do something about it. No type of payment arrangement is good for them, they want whole payment plus attorney fees. Anyone have an idea as to what I can possible do? |

First of all make sure the papers they sent to you are the real thing, sometimes they will send false documents just a to get a payment, If you pay you start the SOL all over again. Send them a vaildation letter. there are numerous places on the internet you can find an example to including this site. After you send them the vaildation letter You will never hear from them again. Make sure your letter is sent certified. Google this name (Bud Hibbs) it a great site for people who live in Texas. Good Luck.

| I recieved a letter from them requesting payment in full I contacted them and explained my situation that I am unemployed taking care of my 3 yr. old daughter that has been diagnosed with a terminal illness and that I could make payments of 100 a montha and they made an offer of $230 a month for the next 3 months which is not even an option I simply don't have it. What are my options? How do I keep them from sueing me? |

| Watch it with CACH, they called my husband and said they were doing an "asset investigation" and that we needed to "do this voluntarily" or they would take action immediately. They asked for our bank info, mortgage, basic bills, vehicles, closest relatives, and wanted name, address and phone numbers of at least 3-5 relatives. I told them absolutley not..they have no right to contact my relatives, and I feel that I have no right to give them my relatives' info, my debt is MY DEBT, NOT my relatives debt. They were very threatening, they called themselves the "legal dept". I told them I would turn them into the FTC for lying, and they said I better never threaten them again. Ha! Then about 3-4 wks later, I recieved a letter from an attorney regarding the account, and in real fine print at the bottom, it said "at this time no attorney has reviewed this account or the specifics of the account". That was about 6 months ago. So, I sent a debt validation letter and never heard from them again. Since then, I have recieved a letter from 3 different attorney offices regarding the same account. They just keep sending it around, hoping they will scare me I guess. So, it makes it impossible to trust them at all. |

Last September or so P Scott Lowery & Assoc (affiliates of CACH LLC) had picked up an account I had with an auto lender, which the lender lists on my credit report as a repo, and had charged off, the man continually called me at work after I told him not too and at home and was very rude. I basically told him off and then did not hear from them again (Collect America is listed on my credit report as a collection account and me being past due). Now about 3 or 4 months ago I received a call from Bronson & Migliaccio, LLP - the gentleman called my job and I asked him not too and told him I would talk to him from home, I never did call him back and he repeatedly called me at work over the last few months and home, leaving messages that I or my attorney needed to call him back right away, that I would be taken to court, that my wages would be garnished etc etc. I finally called him last week to try and rectify the situation, set up payment plans or something and he stated that they were representing CACH of Colorado since I'm in Maryland, and a summons had been issued to take me to court and if i hadn't received it already that i should be receiving it shortly (I still have not received any summons..but i did search the case number in the court system yesterday and see that there is a case filed, with a hearing date of Nov. 1st). He asked if i could make a lump sum payment of $5k and it would clear everything or else make monthly payments of $1K something on the $8k or so I owe (which included court costs etc), I told him that was too much for me so he came back with that they would accept payments of $692 a month, I agree'd (though I know I can not realistically make those kind of payments every month, I'm a single parent) He said they could halt the summons if i made these payments and asked for a check by phone, I told him I was not going to give him my checking information and if they did not like that we could go ahead to court. He stated that the company then said I could send a
money order, it has to be in by the 18th and if it's one day late the negotiation was off. He sent me a letter to sign and send back titled 'Judgement by Consent with Stipulation Not to Enforce' and on the top it has Cach LLC vs me with a case number and such. The second sheet is a Stipulation Worksheet which asks that I list all real property I own, all bank account information and work information. I'm not sure what my next steps should be....do i go ahead and pay this $692 before the 18th (Friday) then let them know that I can not continue to pay
that amount? can they garnish my wages? I know that I owed this money to the auto lender and I dont want to continue to run from my obligation or have my credit tarnished anymore then it already is. I never did request a debt validation letter from Bronson & Miggliaccio because I never knew I could until just looking over this site...is it to late to do that? should i send them a validation letter before sending any monies? which would mean i will miss the deadline they gave me of the 18th. | You can still request validation, but if you recieved a letter giving you 30 days to ask for validation, then they probably will not honor your letter. You can request in writing that they only contact you by mail and that all phone calls need to stop. They DO have to honor that, and will no longer be allowed to call you at work. As far as wage garnishment, it depends on the state that you live in. The attorney general's office in your state, and the FTC website can probably tell you whether your wages can be garnished. DO NOT fill out that Stipulation worksheet though. That is used by them to decide if you own anything they can put a lien on, or if you are worth suing. They will use any and all info against you. They do not have a right to that info as far as I am concerned. I would check with an attorney about that letter of consent of judgement, sounds very sneaky. It sounds like you would be giving them a judgement against you without going to court, they would definitely use that against you in court if you sign it. You are making a promise by signing that. If you cannot keep your promise and you know that now...then DO NOT sign it. |
