| I had never heard of CACH LLC until about a week ago. A process server came to my home and served me as a John Doe... They are saying that I am married (which I am not and have not been since 1993) and that I am required to pay my spouses Household Finance bill of $2600. Just because my last name is the same as the lady they are seraching for, they can (in Arizona) I found legaly serve anyone as a John Doe - who MAY have similar names in thier family. |

| I was sued by cash but when the guy try to come to my house i dont open the door, this help me or even if i dond receive the papers i need to go to court |

| Interesting thing happened to me. I got a summons delivered by the sheriff. So I called these bozos to find out what debt it actually was. It is an old providian account. They sent me a judgement packet, it says judgement by consent. Yeah right, I did not sign it and mail it back, I sent them a debt validation letter instead. Does anyone know how long it will take these guys to get back to me on this. |

| Hello, I have been viewing replys about CACH LLC. I have a question of my own about this company. I applied for a PAYDAY loan for $500.00, I received the loan and paind back $300.00. Well of course financila issues came up again and I wasn't able to pay them. They turned it over to collections and when I received a letter from the collections people, I don't remember the name, they stated on the letter I still owed the payday loan company $400.00. I sent them receipts stating I only owed $200.00 and they sent a receipt saying they will accept the $200.00. I misplaced the letter where I was suppose to send my payments to and have never heard back from them until today. Today it was a letter from Equifax & CACH LLC is now on our Public Records stating we owe them $470.00. I'm assuming they will take us to court if they do not receive payment from us since it's showing on our credit report in the Public Records section. There is also no phone number listed on the report. I tried calling Equifax and the only numbers I keep getting are numbers for me to buy a credit report and it's a recording. I called the Payday loan and they said they no longer have our account they gave it to a company called Riscuity. I called Risquity and they have gone out of business and the number has been disconnected. The payday loan company said they have no idea what I need to do. Can someone on here help me. Thanks in advance. |

Ginger,
There should be advice on the summons that you have 20 days to respond, do not avoid this or they will win by default. You need to either contact a lawyer or do it yourself.
You can answer the summons by typing up a front page just as they have, only reverse the information putting you first as the defendant of course. Then on a second page. number and answer to each allegation. For example.
on theirs:
1. XXXXX is an adult that lives at 1234 dillyduck lane, wayward NJ
Your response would be:
1. Yes, XXXX is an adult who lives at yada, yada, yada
The lawyer I consulted told me that only to confirm or deny each number.
their statement:
6. XXXX owes plaintiff X amount of money, with 6% interest, yada yada
my response
6. Denied
(reason, I did not ever enter into a contract with the collection agency, they are not the original lender)
I then filed it with the prothanotary office that the case has been filed in. Make sure you put your signature block, just like they did. You are more or less, reversing the document on them and filing your answer. You must do it with in 20 days or loose by default. Most people blow it off and lose that way and they get a default judgement.
I am waiting on a response from them now. This suing started back in December and I have yet to get a court date, I have all my ammo and am ready to go, wish they would hurry up already, getting bored with the whole mess. _________________ Working my way out of this debt, one day at a time! |

| Make sure the bill they are trying to collect is not past your states statute of limitations. If the bill is older they the statute, them send them a cease letter and wait until it is removed from your credit report. IF YOU SEND THEM A PAYMENT YOU START THE STATUTE OF LIMITATION ALL OVER BE VERY CAREFUL! |

| The amount the lawyer says I owe I believe I do but on the letter I received from the lawyer has a different cc acct number and says it's from a bank in Maryland. Should I send them a debt valedation letter? |

I just finished extensive research on
CACHE-- CAVC--CACV--no matter what name
they use - it all stems from a Colorado,LLC
lawyer.
This creep attorney figures he has hit the
lotto by scouring the country for low life
attorneys who couldn't defend a doorknob.
The Colorado lawyer claims NOW to be the
so-called original creditor [right!]
because the account was "transferred" to
him. He hires lawyers to file lawsuits
against accounts that have been discharged~
[charged off]
BEWARE-IF you pay them one dollar - it
starts the SOL all over again AND you are
stuck with the debt that the original
CC company has already written off!
OK-- my friend was served a complaint for
such a charged off debt - but these
clowns will be surprised because he is
going to fight it in court.
I just found 4 dismissed cases in Sacramento
CA court dockets because they are too
stupid to file proof of service... so go
figure-
Between ex-used car dealers working the
phones and these attorneys- this board
should be very effective in showing them
that as a united community - regardless
of our debts - must be afforded the dignity
and rights our constitution was intended
for.

Who is the attorney filing the suit against your friend? I am in the exact same boat with an attorney suing me for CACH. I am going to fight them on it for the bogus debt validation. How far is your friend into the process, does your friend have a court date yet? CACH is terrible to deal with, they will go away with for awhile and then show up in form of a lawsuit with a local lawyer in your local courthouse, that is what happened to me anyway. _________________ Working my way out of this debt, one day at a time! |

| Thrown out in Sacramento is correct. This attorney can claim to be "original creditor" all he wants, but the law won't hold it up. That's rather fraudulent. |
