Cache LLC showing Unprofessional attitude - How to handle it


Cach LLC is a debt collection company operating from Denver, USA. It buys charged off debt accounts from various lending institutions and tries to collect them from the debtors by harassing.

Is Cach LLC highly unprofessional?
Cach's mode of operation is highly unprofessional and they do not keep any stones unturned to harass people. Let us see some of the incidents:

  • Consumer feedback suggests that Cach LLC harasses customers over phone.
  • In majority of the cases it was found that they had changed the date, when a borrower had made the first default payment.
  • Cach LLC also threaten people to pay up by giving the excuse of repairing the credit report.
  • They send false reply in response to debt validation letter
  • It has been reported that Cach LLC wanted to settle payment plan verbally.
    Example: When a borrower wanted to pay the outstanding amount and asked for a payment schedule, Cach LLC decided to give the schedule over the phone. They were against documentation.
  • In several cases, the unpaid amount was tampered with and presented in an inflated manner.
  • Cach LLC takes advantage of a borrowers who do not know the rules of SOL(statute of limitation) and re-open "dead" debt accounts.

Can the above Problems be Solved?
  • In case of payments, re-started by Cach LLC, you should always check the details and gather all possible legal information before paying them.
  • Making harassing calls is not allowed and violates the Fair Debt Collection Practices Act. One may take legal action against the collection agency.
  • You can send a Debt Validation letter to Cach LLC if you have any doubt on the concerned debt. After you send the DV, the Collection agency can't harass you in any way until and unless they verify the debt.
  • Instead of negotiating with the collection agency, Cach LLC, it would be best to communicate with the original creditor.
  • It is advisable that you should keep all documents, in written format, of any transactions done with Cach LLC so that you have a document of the same at the time of any future adversities.
  • If you are sure that the debt is not at all yours then you can also take help of a Cease & Desist Letter to stop their harassment and complain against them in Federal Trade Commission and your state's Attorney General.

Anyone heard of CACH, LLC? I got a letter from Workman Law Office in Jacksonville, FL stating they represent CACH, LLC. They say that they have not reviewed my account but are demanding payment . I am sending a debt validation letter tomorrow morning.just wondering if I can get some info. I have never recieved anything from CACH, LLC. Thanks.

TMD,

CACH, LLC seems to be a bad debt collector involved in unfair activities. I have collected some info on them from net. They buy debts that are older. They have many outlets all over the country and they assign each of the debt accounts to one of the offices they have.

Check the SOL in your state. Once the SOL is expired, no one can legally compel you pay the debt. Send them the DV letter through CMRRR, so that you can have evidence of your correspondence.

Hi TMD

You must be now having a fair idea of how to deal with such collection agencies. After you have sent the debt validation letter, they are immediately required to send you the account details. You have the legal rights to place any items on dispute if they are incorrect. The collection agency has to verify it with your original creditor and show proof of the verification if you request. Do not pay anything unless you have seen the details of this account properly. The FDCPA law gives you the legal powers to refuse payments until the debt is completely validated.

Send all your letters through certified mail with return receipt requested. You will have proof of all the correspondences made with this company on the specified dates. Do keep us posted in this matter.

I was trying catch up on a debt this year and recieved a verication letter in Aug.I told them I was sending money and asked about a payment plan but never heard from them. Then in dec I got calls from a law office stating that CACH LCC has bought the debt and wanted money.Then recieved another letter and the next day another call.They never even talked about the letter only that I should refinance to pay them. Also said dont try to for chapter 11 or 13 because you can;t. I told them all I wanted to do set up a payment plan. When I mentioned about the letter in aug they said they didn;t know anything about it. Wouldn;t they know about it?? They knew i was paying but stopped when I was waiting for an answer .

THennies, how old is this account? Did you check your credit report and get the latest status of this account? Make sure that you don't pay to anyone trying to pocket your money. Have the complete details of the account from the company before you make any payment agreement. Send a debt validation letter and get the details of the account. This will prove that you will be paying to only that company responsible to collect money from you.

I havehad this account for a long time until I lost abouy 1/3 of my pay 3yrs ago. last jan started working more and started to make payments evey month to the orginal creditor. Then in Aug got a letter and told them that and asked for a pyment plan or a better way to pay .never heard back untill last week when someone fron CACH called and called then recieved a letter last friday and they still called.Wanting me to refinance borrow or anything else to pay them. I have decied to send them a cease communcation letter and start to pay the orginal creditor and see what happens.

Yes, contact your original creditors and get information about this account. If CACH calls you further, ask them to send the details of the debt in writing. See whether your payments made are updated with them. If you find the details incorrect, place it on dispute. They will verify it with your lenders and give you the accurate picture of this debt. You will be assured that this agency is authorized to get money from you. Otherwise, make arrangements with your original creditor only and get receipts after each payment. You will be sure that your money is going towards your debt account.

I have sent CACH,LLC a cease commucation letter.And have made a payment on the credit card debt. And will continue to so only with the credit card company as it was stated in the letter. I have read enough on the this web-site not to trust anything CACH has to say or do.How wpuld I go about replying to thier letter asking for a validation.and will dispute the amount they claim I owe.Should I also push for thier verication or judgment they say they have.Seems all went well last year with the credit card company until CACH started to hound me

Hi THennies, the company has already sent you some information about your account. So, from their point, they have completed the debt validation process. Now, you need to highlight the items and dispute with them. The amount they claim you needs to be verified with your original lenders. They will get the update from the original creditor about them receiving your money and won't contact you further.

In the meantime, be sure to get a receipt from your creditor that they have received money from you. This is your final proof of the efforts made in paying the account.

Debt validation process applies to the debt collection agencies who are authorized to collect money on past debt accounts from the consumers. Any collection agency holding your accounts from the creditors must give you the details of the debt within 5 days after placing the initial communication with you. The entire process of giving you the accurate details of the debt is termed as debt validation under the FDCPA laws [15 USC 1692g]

Hi..thanks for the information.I do have a cpoy of payment sent though my on line banking and will send them that also when I dipute it.I went to the website you gave Bryon.On about the 26th of dec they called and someone asked if I recieved a letter from them and told them no but did get one back in Aug and wrote back telling them I was paying on the debt and never heard from anyone after that.Then they started to tell me I had to pay them.Then I did recieve a letter on the 29th of Dec from them.They had it dated for the 22nd of Dec.Just wondering if they goofed and back dated the letter. But am going to the validation process going. I sent them the cease to commucate letter and guess what. Tonite when I got home from work on my answering machine I recieved an automated call wanting me to call back.Are they in violation or trying to get me to call back to start this whole thing over again Thanks

You have restricted the company from calling you by sending the C&D letter. They should not have called you over the phone. If you want to take any legal actions against them, consult your lawyer.

Debt validation is of course necessary to get the accurate picture of the account. Send your letter certified with return receipt requested and cover your base legally.
