Like all of you, I am a victim of Palisades Collection LLC. In 2003 I was a victim of identity theft and thought I had the situation under control. NOT. I recently applied for a small loan from my bank and was turned down. Low and behold Palisades. A Verizon bill opened in 2003 to an address that I have never lived.
I immediately notified Palisades over the phone in an attempt to get the process started to get this matter under control. Although the representative on the phone was very rude and unwilling to assist in getting the situation under control I learned a few things. (1) the account was probably opened by phone as they had no way to validate the account. Meaning anything with my signature. (2) I also learned the address for which the account was opened. I have never lived at that address. Upon learning I was a victim of identity theft I filed a police report. The police report clearly states my residence at the time the account was opened. I even told this to the lady on the phone and she seemed concerned with nothing but collecting the $302.87.
Since I knew that I had the right to request validation I being rude myself told her that I am now requesting validation of the account and would mail a letter certified receipt request the next day. I also told her to cease all attempts to collect the debt until verification has been received. She told me that I have to fill out a fraud packet that they would send me in the mail. I received the fraud packet in the mail and there are a couple things that bothers me about this. The on first page the top portion says detach and return with payment. Once I notified them that the account was being disputed don’t that mean that ALL collection activities are to be immediately ceased? All other subsequent pages of the fraud report that they sent me, at the bottom of the page it says in clear bold words DO NOT SEND AFFIDAVIT TO THE FTC OR ANY OTHER GOVERNMENT AGENCY. If this orgainzation is conducting legitimate business in a legal manner why would this statement be necessary.
My question is do I have a legitimate claim to sue these people because it is evident that they applied this information to my credit report knowing full well that there was no contract with the original company that this debt was incurred with? It also appears that this company Is trying to hide their business practices from the FTC and the government. I have had the information removed from my report but it took some long conversations with the credit bureau and some really heated conversations with Palisades. These people in view are scam artists and they need to be shut down and placed under the jail.
