Community discussion - Palisades Collection is not cooperating!

I'm still waiting ... I have been working on my follow up letter to the "goodwill" letter that I sent to AT&T, Palisades and Pattenaude and Felix in the event that Transunion and Experian don't remove them. None of the creditors/parties involved responded to my goodwill letter, I assume because it is a paid off item that they just don't care, and maybe they legaly don't have to respond? And I am holding out hope that the goodwill letter will actually work and that Palisades won't respond to the disputes. I have 2 more days to wait on the Transunion dispute, and 4 more days to wait on the Experian dispute.

I basically based my complaint on 2 things: first, obviously were the fraudulant charges that Palisades claims that they "wrote off" out of the goodness of their hearts. They sent no documentation to me when I asked Patenaude and Felix for it, nor did they give me the opportunity to pay these supposed fees. I wouldn't have paid the full damn balance if I wanted a "settlement", would I have?

The second part of my letter will address the fact that Patenaude and Felix had no legal right to write the paid in full letter (that was actually incorrect as far as they are concerned NOW) and I guess I will take that up with the Nevada Bar Associaton as well as anyone else that is suggested on here? If they didn't have the authorization to write the letter, why did they? And also the 3 letters that I have were all supposedly written by the same attorney, but all 3 of the signnatures are drastically different and were obviously signed by 3 different people but the same name each time. Can that be addressed as well in my complaint?

I sent them a partial payment. They never credited my account. When I called them they denied ever recieving the payment even though I have the cleared check, deposited by them. I am in contact with the Federal Trade Commission.

I feel for ya smo65d11 , what a big headache! I would include all of that in the letter, isn't signing someone else's name fraud or forgery? And if this someone wasn't a lawyer then that is also impersonating council which I think is against the law as well (not sure).

I really know how you feel about being at the suing stage and not having the money to sue! I am at that stage with Arrow...I am all ready to sue but can't even manage to scrape up the money for that due to being out of work and being in a hit and run accident...just hang in there.

it is disheartening, they are all basically allowed to do whatever they want and we have no recourse whatsoever. The credit reporting agencies do NOT care about the consumer, they do whatever the paying collection agencies want them to do.

If I owed the money I would have no problem paying them, just like I paid every dime owed to all of my other creditors. The fact that they are trying to further ding me will not go unchallenged, I am pursuing legal action against Palisades, Patenaude & Felix as well as the 3 Credit Reporting Agencies who are allowing these collectors to cause needless damage to the American Consumer's FICO's.

I've read through all 23 pages in this thread (and some others) and have a related situation that I don't think has been covered.

I disputed charges of about $145 while I was a customer of AT&T 2-1/2 years ago. This was turned over to a collection agency (not Palisades). When I received their notification in the mail I asked for verification. None came and soon after I received a similar letter from a different collection agency (again, not Palisades). Again I asked for verification and again nothing was sent in response and then the third collection agency, now Palisades, sent me a letter. I didn't respond within the 30 days and have completely ignored their letters and phone calls. In July I pulled my credit reports and the $145 was listed under Palisades and under another of the collection agencies (Nationwide Recovery). Through Experian, I initiated an investigation citing something to do with unauthorized charges (don't remember the exact wording). At the end of the 30-day investigation period through Experian both of the negative items were deleted from my report.

Today I received a packet from Palisades stating that they have received my claim of dispute and they have placed my account in a "disputed" status while they investigate. They want me to provide an official police report detailing my claim (2-1/2 years ago!) and a signed and notarized Affidavit of Fraud. They also state that if they do not hear from me within 30 days then my claim will be withdrawn. Then they provide the following account infomation: previous creditor, current creditor (themselves), current balance, account number, last 4 of my ssn, debtor #, charge off date (AT&T), and open date (AT&T account).

My questions:
Since up until this point I have been silent to them, should I continue to ignore their requests for payment? I am hesitant to open up a can of worms, since it seems that even paying the amount in full is no guarantee that will make the problem go away (according to accounts in this thread and elsewhere on the web).

I do not intend to provide them with any additional information on the multiple forms they sent or a police report or affidavit of fraud, but I'm wondering if they would actually withdraw my claim and re-enter the negative information to the credit agencies. Once it has been deleted can it be reinstated? If so, do I have recourse through the credit reporting agencies?

Is the information they provided as being part of my file the same as what they would provide if they were to respond to a request for validation? Is it worth pursuing a request for validation at this point?

Is it legal for two collection agencies to list the same debt on credit reports?

It would be great if someone knowledgeable (JCEMT? anthonylemons? anyone?) is still reading this thread and could give me some idea how to proceed....thanks in advance.

How were you served?
Who is suing? Palisades on behalf of the OC or just Palisades? What state do you live in?
When was the last time you paid on the account?
What else came with the summons?

No Name, it is not up to you to provide proof, many CAs use this tactic to intimidate you. The only time you need to do these things is if you are a victim of identity theft, disputing charges does not fall under this.

Send them a DV letter and in this letter inform them you do not think this is a case of identity theft, you simply want proof of these charges because you think they were made in error. Also inform them that until they provide said proof, they many not reinsert the collection back onto your report as that is an actionable violation. Also inform them that what they did provide is not considered proper validation as it was not provided by the original creditor and is simply repeated drivel on their own letterhead.

Nope, it is not allowed for the same account to be listed by two different collection agencies, what will happen is that the older one will stay removed but the latest one the CA may try to reinsert, but then you have them if they do this after you sent a DV.

I thought this site was to help poeple who were wrongfully accused or were falling? JULIE comments is like a radical saying this is why I didn't pay and it is very bad--reason America is so far in debt and people do not fess up to their real obligations
JULIE LIED ABOUT DEBT OWED AND GOT OUT OF SOme of them===her credit history I think for at least mext 20 years is in question unless she clears off things she denied and has not paid for yet!!!!!!!!!!!

The debt I had with AT&T was legitimate and it was transferred to Palisades Collection Agency. Through a debt consolidator, I was able to final payoff my debt. However, I wasn't keeping track of the payments. I decided to call Palisades (in July '0Cool to check the balance due. I was advised that my account was paid off in March '08. I informed them that I had sent at least 3 additional payments since March, therefore I was due a refund. They saw the 3 payments and agreed I was due a refund. I was told that it may take some time to process. So, a month later after not receiving a check, I call again was told its going out at the end of the month. A week goes by and I call again. I was told that the check would be sent by the end of the week. Yet, I do not have a check. I'm going to request to speak to a manager/supervisor tomorrow. What are my rights? How can I complain and get results?

Do you have anything in writing regarding them agreeing to send you a refund?

Do you have proof of each payment versus the original debt?
